Appeals Court Returns Wiretap Case to Lower Court
A federal appeals court on Thursday declined to rule on whether lawsuits seeking to target President George W. Bush's warrantless wiretapping are covered by secrecy laws or can be challenged in court.Citing the FISA Amendments Act of 2008, a three-judge panel of the 9th U.S. Circuit Court of Appeals on Thursday sent the case entitled "Hepting v AT&T" back to a district court that had heard an

Exposure of Warrantless Wiretap Program by NYT Did Not Damage National Security, says McClellan.
I know what you’re thinking: You are certain that in the 29 gazillion press availabilities that you have watched, you have heard everything that former White House press flack Scott McClellan has to say about George W. Bush’s great American truth killing machine. But there he is, on the radio, on the TV, up in the sky. . . and you find yourself looking and listening again. OK, I didn’t see h

Wiretap at Ballfield Leads to Conviction of Reputed Mobsters
You can now rule out the baseball field at Glen Cove High School as a place where it is safe for organized-crime figures to plot their racketeering activities. Two reputed members of the Colombo organized-family were convicted Thursday of racketeering and extortion after a trial in which testimony centered around FBI wiretap's made with bugs planted at the school's ballfield, according to

US Says Wiretap Program Will Now Require Court Approval_More Trouble for Somalia
This week - new developments in two stories we reported on last year.In August, a federal judge tried to stop what the Bush administration calls the Terrorist Surveillance Program. A presidential order let the National Security Agency read e-mails and listen to calls to or from al-Qaida suspects in the United States without a court order. The judge in Detroit said the program violated rights of free speech and privacy. She ruled it unconstitutional and in violation of a federal intelligence law.In October, an appeals court said the government could continue the program while it appealed the ruling. But this week the administration said it has ended the use of surveillance without court approval. It says the program now operates under rules prepared by the Foreign Intelligence Surveillance Court.Democrats, newly in control of Congress, praised the move but said it should have happened sooner. Senator Patrick Leahy of Vermont said there are still questions about exactly how the program wil

      Dodd Stalls Wiretap Immunity
On Thursday, out of the Democratic dung heap, emerged a person with courage and conviction. The Democrats in Congress were about to cave in once again, when Senator Christopher Dodd said enough is enough and put a hold on a bill that would have granted immunity to the telecommunications companies which assisted the White House in committing illegal and unconstitutional wiretaps. So despite the efforts of the Democratic pussies to appease our dear President, the bill is now stalled. In 2001 Bush authorized the NSA to secretly wiretap Americans without a court order, which happened to be illegal. Telecommunication companies jumped at the chance to give away private citizens' records and Comcast even charged the government a thousand dollars for each record. Now please don't comment that the poor telecoms were just following orders. That issue was settled a long time ago at Nuremberg. And it is not like these guys are wanting for legal representation, which is quite capable of evaluat

      White House Wiretap Subpoenas
In addition to subpoenas issued to the White House, the VPs office and the Department of Justice: “the panel is seeking materials on related issues, including the relationship between the Bush administration and several unidentified telecommunications companies that aided the N.S.A. eavesdropping program.” So upon the question of illegalities in the NSA program, the usual games of rhetoric and politics can be played. Patrick Leahy (D-VT) called the response prior to the subpoenas issuance as ‘“stonewalling of the worst kind.”’ May saw the testimony of James Comey a former deputy AG during which he described a March 2004 “confrontation” between Justice officials and White House aides regarding the “legality of the wiretapping program.” Of the testimony Chuck Schumer (D-NY) in fine politically tuned rhetoric said: ‘“The Comey testimony moved this front and center. Alarm bells went off. His testimony made it clear that there had been an effort

May 14th Is FBI Internet Wiretap Day!!
Happy Friggin Monday … NOT Hai 2 U Americans. Get your privacy apps and proxies ready, cause the FBI will have all their gear set up by Monday May 14th: May 14th is the official deadline for cable modem companies, DSL providers, broadband over powerline, satellite internet companies and some universities to finish wiring up their networks with FBI-friendly surveillance gear, to comply with the FCC’s expanded interpretation of the Communications Assistance for Law Enforcement Act. Isn’t that special? Oh well, its not like “they” weren’t listening in the whole time anyway. Only now, its all legal thanks to a bill, aka CALEA, passed by Congress in ‘94 to help expedite the process of phone/cellular wiretapping, which was expanded to wiretapping the net in June of 2006. Unfortunately, we can’t just blame G W Bush for all this crap.  Darn. However, fear not! An IP address does not represent a person. They are easy to change and easy to
