      New York subpoenas firms in mortgage fraud probe
      Reuters has reported here that the state of New York has subpoenaed three large Wall Street banks (Merrill Lynch, Bear Stearns, and Deutsche Bank) pursuant to a probe related to the creation of mortgage-backed securities.  The New York probe reportedly is looking into how mortgages were packaged together by Wall Street to create securities sold to investors and the banks’ relationship with credit-rating firms.

      Cuomo Subpoenas Street Firms on Underwriting As part of an expanding probe into the mortgage crisis, New York Attorney General Andrew Cuomo has subpoenaed loan underwriting records from a handful of Wall Street firms, according to industry sources. Wednesday morning The Wall Street Journal identified three firms that reportedly received subpoenas: Bear Stearns, Deutsche Bank, and Merrill Lynch. The Attorney General’s office has already subpoenaed records from contract underwriting firms, including The Bohan Group, San Francisco, and Clayton Holdings. One executive close to the matter indicated that “The Street is trying to blame the contractors they used.” At deadline time, a spokesman for the Attorney General’s office had not commented. The House Judiciary Committee has authorized contempt charges against White House Chief or Staff Josh Bolton and former White House Counsel Harriet Miers for failing to respond to a subpoena issued in connection with the illegal firings of 8 U.S. attorneys. The Justice Department (read: Alberto Gonzales, the very man being investigated) has now officially said they will not prosecute those contempt charges, bringing Congress and President Bush ever closer to some kind of Constitutional showdown.       Subpoenas Issued over NSA Warrantless Wiretapping
      The Senate Judiciary Committee voted Thursday to subpoena documents from the Bush Administration related to the government’s admitted eavesdropping on Americans’ overseas emails and phone calls without getting court approval. In a 13-3 vote, the Committee decided to authorize chairman Patrick Leahy (D-VT) to issue subpoenas for documents related to the NSA warrantless surveillance program.   Nearly any request is going to be met with tough resistance from the White House, and the confrontation over the documents “could set the stage for a constitutional showdown over the separation of powers.” The subpoenas have long been expected from the Judiciary Committee. If the Administration decides to ignore the subpoena, the Committee can find the President or Attorney General in contempt, ask for a full Senate vote and then force a U.S. attorney to prosecute.
