If there's a housing downturn in the United States, someone forgot to tell Canadian builders. It looks to be a busy fall season in the construction industry, as contractors took out $6.3 billion worth of building permits in August, up 1.4 per cent from $6.2 billion July, according to figures released by Statistics Canada yesterday.This is the fourth-consecutive month that permits have gone above the $6 billion mark since the one-month record of $6.9 billion was set in June. The standout nationally was Saskatoon, which has already broken an annual record in the first eight months of the year, surpassing the previous annual record of $421 million in 2006.

Future Access Still an IssueThe National Marine Fisheries Service (NMFS) has denied issuing Exempted Fishing Permits (EFP) to 13 pelagic longline vessels to fish within closed zones off the east coast of Florida. The recreational fishing community expressed strong opposition to the permit application noting that the zones were closed to provide protection for critical habitat for juvenile swordfish, sailfish, blue marlin and white marlin. At the time the agency considered the permits, it was reassessing white marlin under the Endangered Species Act (ESA). Longlining in the closed zone would have increased white marlin mortality, as well as that of other species, so it made no sense to approve a “federal action” that would have negatively impacted white marlin. Today my friend and colleague, Beth Butler, COO of EWM Realtors and I, discuss one of the recent changes to the Florida Association of Realtors contract. Hopefully this discussion will shed some light on how these changes may impact the consumer with regard to open building permits, and the rights and obligations of both parties in as-is vs. warranted contracts.
Beth: Kevin, how would you describe an as-is sale from the standpoint of the seller?
Kevin: Well Beth, very simply put, in an as-is sale, the seller is not contractually obligated to repair any items.
Beth: From the buyer’s standpoint, what happens if the buyer finds something, as a result of the inspection that they can’t live with? Must they proceed with the sale on an as-is basis?
Kevin: No, the buyer has a few choices, including:
1. Accept the property in it’s as-is condition
2. Negotiate the finding with the seller

The National Marine Fisheries Service (NMFS) has re-opened the comment period on a request for an exempted fishing permit (EFP) in the East Florida Coast and Charleston Bump closed zones. The extended comment period closed on April 25, 2007, but has been re-opened until 5 p.m. on June 20, 2007. If approved, this exemption would allow 13 longline vessels to fish an area now closed to longlining in federal waters 40 miles north of Fort Pierce (~ 280 N. Latitude) and east of the axis of the Gulf Stream, continuing northward and east to the 100 fathom contour and the northern boundary of the Charleston Bump closed area. TBF opposes the issuance of such an EFP as the intent of the permit is not scientific or experimental but is solely to allow longlines to fish in the closed area.
