Being in HR, I cannot run away from this subject. We in HR always face this issue. Employee’s claiming that they were ‘forced’ to resign by the conduct of the employer. They then run over to the IR office causing us in HR another late day at work and a lot of paperwork.
But ‘forced’ resignation [...]
We often associate dismissal as an act of an employer firing or terminating its employee from employment. However, constructive dismissal is somewhat different.
Constructive dismissal is not really a ‘dismissal’ per se because the one terminating the contract of service or employment is the employee himself. It is defined as an act of an employee terminating [...]
Activist Mark Wattles has had the best line to date on Circuit City's (CC) turnaround effort.
Wattles said management "has repeatedly touted the fact that they have cut $200 million of annualized selling, general and administrative expenses while ignoring the fact that approximately $500 million of gross profit has been wiped-out in the process."
Beautiful...
He has also nominated 5 people to the Board of Directors and a proxy fight is on.
I first wrote about CC almost a year ago now and...

Those of you interested, I wrote a quick post this morning discussing Dan Dakich’s huge huevos for dismissing Armon Bassett and Jamarcus Ellis at the Dagger. Here’s a little taste:

The school reported a total of 71 absences the last two days, though students may have been out for any number of reasons.Critics of the principal said about 50 families have issues with her. On Wednesday, about six parents passed out fliers before school, urging others to join their group. The protesting parents said she doesn't respect students or adults, speaks with an intimidating tone, behaves like a bully and creates a hostile environment. Remember those insurance commercials featuring the "Good Hands" people. Those were the days when a cup of coffee was 50 cents, the milkman delivered and people expected to retire from the same company where they had come up from the Mail Room.
But this is the 21st Century; It costs 50 cents to put air in your tires, your doctor answers by voicemail, and your chances for freedom at 65 seem about
Its been a strange week, nothing seems to have happened yet the reality is quite to the contrary. Like I said strange, huh? There are a few things I have not been able to get my head around. Firstly and my main complaint has to be the aggressive generic letters I have received. One from the TV licensing company telling me to ‘cough up or else’ or alternatively if I don’t have a TV (which I don’t) I should inform them by ringing their premium rate number. Fuck off will I, they can waste their money sending more generic letters that I’ll ignore.Secondly the ‘Dear Resident’ letter I received from the beloved site manager team, yes those fuckers. They have decided to tell me to stop smoking cigarettes, cigars, pipes and hookah (which they informed me is another word for shisha). I don’t particularly care if the other students covertly smoke out of their bedroom windows, but I don’t appreciate the site manager team’s indiscriminate approach to heckling the non-smokers.I w

As expected, today’s teleconference with AD Rick Greenspan, Associate AD Grace Calhoun and Ice Miller council Robin Green Harris answered few questions. I’ve got no problem with the Athletic Department refusing to answer questions because the case is in the hands of the NCAA.
They obviously don’t want to slip up and give the NCAA more ammo than they’ve already got. But why schedule time to answer questions if you have no intention of doing so? Haven’t we heard enough of their legal speak fluff?
The more I’ve thought about the way Rob Senderoff’s dismissal from the program was handled, the more I’ve come to the conclusion that those who are in decision making positions, namely Rick Greenspan, botched the whole thing.

The dismissal of U.S. Attorneys controversy is an ongoing U.S. political dispute initiated by the unprecedented midterm dismissal of seven United States Attorneys by the George W. Bush administration's Department of Justice (DOJ) on December 7, 2006, and their replacement by interim appointees under provisions of the 2005 Patriot Act reauthorization. The dismissed U.S. Attorneys had all been appointed by President George W. Bush and confirmed by the Senate, more than four years earlier. At least two other attorneys were dismissed in 2005-2006 (which is why press accounts often cite nine dismissed attorneys). Twenty-six or more U.S. Attorneys had been under consideration for dismissal during this time period. The firings received attention via hearings in Congress in January 2007 and by March 2007 the controversy had national visibility. Attorney General Alberto Gonzales stated that the U.S. Attorneys "serve at the pleasure of the president" and described the affair as "an overblown pers

Baltimore Ravens quarterback Steve McNair is scheduled to appear in Nashville, TN today on a driving under the influence by consent charge, along with his brother-in-law, Jamie Cartwright, who was arrested on a DUI charge, reports The Tennessean. “I think there is a very good chance to get it worked out as far as the driver is concerned,” said Roger May, McNair’s lawyer. “If that occurs, then Mr. McNair’s case will be dismissed.”
It initially appeared that McNair’s case would be dropped on May 30; a clerk for the criminal court in Nashville announced that McNair’s DUI by consent charge had been dismissed and that the DUI charge against his brother-in-law had been reduced to reckless driving. But the district attorney decided to review the agreement, resulting in both cases being delayed until today. May said yesterday that he has never been given a reason for the delay. McNair was arrested May 9 in Nashville on a mi

Minister/State Secretary Yusril Ihza Mahendra said he was ready to face any risk including a dismissal in connection with direct appointment and mark-up allegations on him when he was law and human rights minister. "I`m not afraid. I will face any risk. A reshuffle can happen any time. Various measures can be taken against one action," Yusril said here Tuesday. Last week, the Corruption Eradication Commission (KPK) summoned Yusril as witness in the case on direct appointment and mark-up allegations in the purchase of an automatic finger-print identification device at the Law and Human Rights Ministry in 2004. The KPK has detained Eman Rachman who is President Director of PT Sentral Filindo, which had been directly appointed to procure the equipment, while Secretary General of the Law and Human Rights Ministry Zulkarnaen Yunus has been banned from going abroad. The case caused a stir when Yusril reported back to the KPK the process of the direct appointment by the KPK in the
A BBC investigation has revealed that cancer patients are facing unfair dismissal and discrimination at work, some have even been sacked after being refused time off for treatment.
A new law which came into force at the end of last year has given much stronger protection at work to people with serious illnesses like cancer.
But the Disability Rights Commission said 200 cancer patients had called its helpline this year complaining of problems at work.
The commission said these cases are the tip of the iceberg and many more seriously-ill patients are still unaware of their rights.
The Disability Discrimination Act, which came into force in December 2005, gives people with cancer and other serious diseases such as multiple sclerosis the right not to be treated unfairly at work because of their condition.
Under the new laws employers must make changes to people’s working arrangements, such as time off for treatment or reduced working hours.
These changes - called ‘reasonable ad
