A prediction on how Ohio state courts handle the ADA Amendments Act

Beginning on January 1, the definition of what qualifies as a "disability" under the ADA will be much broader statutorily. One of the key changes is that the Sutton v. United Airlines U.S.

For good measure, Congress forbade the courts to second-guess the secretary’s determinations. So long as Mr. Chertoff is willing to say it is necessary to void a given law, his word is final.I remember reading about this law when it was first passed. I remember thinking that the courts would certainly step up and strike down any law that restricted their own powers as granted by the constitution. In principle I think that this is a good idea.  Groups of people deciding independently on issues can be a very effective way to producing fair results (see The Wisdom of Crowds by James Surowiecki ).  It will certainly be more effective than eBay employees deciding from on high. However I have several reservations about this system and I fear that it will require significant changes before it can really work. Lack of incentive for jury members.  Who has the time to do this, and who cares?  eBay is a commercial company and not a public service, why should I give my time to them for free. Acomplia Ruling To Go To German Courts
In a decision that was expected by all of us at Ukmedix the German Ministry of Health has decided that the Acomplia weight loss drug that is made by Sanofi Aventis will not get the full reimbursement status from insurers that its manufacturers were hoping for. Instead the Ministry of Health has classified it as a lifestyle drug and therefore not as completely essential. However Sanofi Aventis have been pointing out that Acomplia does not just work for weight loss but can help with metabolic factors such as reduction of cholesterol and has been shown also to help diabetic men and women too. The way the rules work in Germany are that if a drug is correctly classified as essential by the Ministry of Health either the state or health insurers are liable to pay for it if a doctor issues a prescription. If the drug does not get the classification then it is up to the individual to pay for it. The decision not to give Acomplia the essential status means that its sales will be severely effecte

Heinze could head for the courts
The Liverpool Echo claims the Argentina international's legal team are bullish over their chances of forcing the transfer at a hearing if United remain steadfast in their refusal to let the player join their most bitter rivals. In recent days it has emerged that the player has a letter signed by United chief executive David Gill claiming he would be free to leave if a £6million bid was received - a figure Rafael Benitez's Reds are thought to have matched. It is not clear if the 29-year-old has a formal get-out clause in his contract. United manager Sir Alex Ferguson appeared to rule out a move to Anfield when he said: "I can assure you, Liverpool will not be getting Gabriel Heinze. "We can put that to bed right now and we have done so. We have had a couple offers for him and we have turned them down

      Courts and Pre-actions.
Ms Penny Mellor stated the following :- 7/7/07 "Issuing proceedings against a complainant at the GMC in order to prevent that complaint from progressing - in order to silence the complainant - is illegal - secondly I shall be going for third party disclosure and I will be find out why editor was really fired"1. Issuing a complaint with the GMC against a doctor with the sole aim of silencing criticism is called "vexatious". 2. Paul Heathcote backed down on the pre-action. A very wise man. 3. I am issuing a letter of claim in the next two weeks. You have the option to respond. If you do not wish to respond, after 14 days I shall issue a claim in the high court for damages. 4. Just remember, I am not Andrew Wakefield, I don't walk out of libel cases on threats of disclosure. You be my guest and obtain third party disclosure from wherever you wish. If you though fail in your disclosure application, I shall claim costs but then I might even show the judge the letters from the Trust without

      NO REMEDY IN THE COURTS
For Richard Marks - Sometimes you need to listen mate -to those who have done it, seen it and got the teeshirt. Remedy UK lost in court recently. The judgment against the Department of Health can be downloaded here and their website has their speech to the masses. I wrote a piece called Black-stones about their choice of legal team. Both I and Jen Colman saw this coming as we both felt that the JR was drafted badly. Anyhow, I tried to explain things to Remedy and their supporters but no one wished to listen. We therefore had to watch while Richard Marks led their team to certain failure. Richard though is a man who clearly feels that the bigger the reputation of the wig the more likely they are to win. He also never listens to what is being said to him. Then again, who are we to criticise him, certainly not one of the accepted masses. Nevertheless, we win in court most of the time. The publicity for this issue has been huge. I though think of our colleague Tushar Bhadra, a lone asian w

The courts flinch on security risks
The Globe and Mail02 May 2007Canada’s Federal Court judges have lost the will to detain foreign terror suspects, choosing instead to release some worrying individuals to the custody of their families. As of last month, even Mahmoud Jaballah, believed to be a senior member of Egyptian al-Jihad, an affiliate of al-Qaeda, has been released on bail. The security-certificate process may now be dead

Courts Reject Da Vinci Code Copy Lawsuit
The verdict is in and according to Britain’s Court Of Appeal in London, The book ‘The Da Vinci Code’ by Dan Brown is not a copy. Authors Michael Baigent and Richard Leigh sued Brown’s publisher, Random House Inc. claiming he copied from their non-fiction best selling book ‘The Holy Blood and the Holy Grail’. Their book was first released in 1982 and controversially dealt with the issues that would later be turned into a fictional bestseller and Hollywood movie. According to Wikipedia: “In summary, the authors argue that there is evidence that Jesus married Mary Magdalene, had one or more children, and that those children or their descendants emigrated to what is now southern France. Once there, they intermarried with the noble families that would eventually become the Merovingian dynasty, which is championed today by a secret society called the Priory of Sion”. Sound familiar? Last year the case came to the high court in England, where

      Lemon Lawsuits Squeeze State Courts
Lemon Lawsuits Squeeze State Courts Jersey judiciary steers parties into mediation to handle surging caseload Monday, July 31, 2006 BY KATE COSCARELLI Star-Ledger Staff It started with an Eagle Premiere that had a wacky cooling system that spewed gunk all over the car. Two young lawyers, just starting out, took the case, brought their client a nice resolution and claimed $30,000 in fees. That was 15 years ago. Today, Robert Silverman and Craig Thor Kimmel are at the center of a small but growing part of the legal world. They specialize in lemon lawsuits, with seven offices in six states, including one in Cherry Hill, a staff of 22 lawyers and several mechanics. "We're certainly kept plenty busy," Kimmel said. "Now there are other firms that have taken on this work. People are more concerned with making sure they get their money's worth." It has been nearly 25 years since states started adopting lemon laws to protect people who buy f

Saudi rape victim falls victim to Saudi courts as well
A rape victim in the House of Saud has now been sentenced to 90 lashes for the "crime" of being alone with a man not-related to her:A 19-year-old Saudi woman who was kidnapped, beaten and gang raped by seven men who then took photos of their victim and threatened to kill her, was sentenced under the country's Islamic-based law to 90 lashes for the "crime" of being alone with a man not related to her.The woman is appealing to Saudi King Abdullah to intervene in the controversial case.I find it unlikely that this awful king will do anything to overturn her sentence. We however can certainly intervene by calling out for help for her! This woman does not deserve to live in the kind of slavery situation she's in, and should be freed from Saudi Arabia as well.

Political correctness and the Ontario courts... again
This time it's a group called Secular Ontario that has suddenly decided to take on a 210-year old practice of saying the Lord's Prayer in Ontario municipal courts.Using the traditional Christian prayer in council is illegal and sends the wrong message, says Sheila Ayala, a member of Secular Ontario.'I think what they're saying at council meetings when they say the Lord's Prayer is that this council is only for Christians — it's not for anyone else. And that's wrong.'— Sheila Ayala, Secular OntarioThe real question is what do they really want to replace it with? Oh of course, nothing. Notice how it's not a religious group complaining but a secular group. Western society in its desire for political correctness has for some strange reason placed secularism as the default belief system. Instead of celebrating different religions, political correctness advocates supressing them all in favour of non-religion. We saw that with the controversy over the Christmas trees in an Ontari

      Mitt Romney courts (other) bloggers
Mitt Romney has been reaching out to the blogosphere. Not this blog, of course. This blog remains steadfastly impartial and so has about as much influence over the Republican Party as the Cloud Appreciation Society (the things one finds online). According to the Boston Globe, Romney has been making sure that bloggers who are influential amongst Republican and conservative circles understand him and, if possible, like him.He has hired Stephen Smith (who, at 24, can surely barely tie his own shoelaces) to run his "online communications operation". Smith was formerly Bill Frist's web guru. Romney has also hired Matt Rhoades who, apparently, has a relationship with Matt Drudge of Drudge Report fame. And you thought the world of South Carolina Republican Party officials was exciting!"The political blogosphere is not just a big convention for political junkies," said Nashville blogger Bill Hobbs. He's talking about you, you know. And especially you, the ones from the Cloud Apprecia

CO Courts say 1st Amendment need not apply
The Colorado Supreme Court, while overturning a 45 day jail sentence for contempt of court for wearing a T-Shirt with a picture of Stanley "Tookie" Williams (more on that later), says,"...wearing a shirt bearing a political message in a courtroom is not protected under the First Amendment."Meaning, the CO Ct believes that your First Amendment rights are valid everywhere but the very place set up to protect that right. Meaning, you can't make a political statement in court. This seems a bit off to me. When did the court become Cuba? I understand that Judges are, in effect, mini-dictators (patience, patience), but now they feel the need to quash political speech? Wow.Now, on to the 45 days for contempt by said dictator.
