      Vermont appraiser pleads guilty to falsifying appraisal
      In the following press release The Office of the United States Attorney for the District of Vermont announced that Gerald Mullaney, 60, of East Greenbush, New York, pleaded guilty on September 24, 2007 in United States District Court in Burlington to a charge of bank fraud. Chief U.S. District Judge Williams K. Sessions III released Mullaney on conditions pending sentencing, which is set for January 28. On November 9, 2006, a federal grand jury in Burlington returned a one count indictment charging Mullaney with bank fraud. The indictment accused Mullaney of falsifying the appraisals he performed for about 100 mortgage loans for homes in northern New York that were financed by National City Mortgage Company. According to the indictment, Mullaney falsely inflated the appraised values of the homes, and his appraisals also provided other materially false information about comparable properties and the properties for which the loans were being sought.       Real estate appraiser convicted after trial in Dallas, TX
      In the following press release the FBI in Dallas, TX announced that following a week-long trial before U.S. District Judge Barbara M.G. Lynn, a federal jury in Dallas has convicted Gandhi Ben Morka on all seven counts of an indictment charging him with various offenses in a mortgage fraud scheme, announced U.S. Attorney Richard B. Roper. Specifically, the jury found Morka, 52, of Arlington, Texas, guilty of one count of conspiracy to commit mail fraud and wire fraud, four counts of wire fraud and two counts of mail fraud. Morka faces a maximum statutory sentence of 125 years in prison and a $1.75 million fine.       Appraiser indicted in Pennsylvania fraud allegations
      In the following May 1, 2007 press release Thomas A. Marino, United States Attorney for the Middle District of Pennsylvania, announced that a Kingston man was arrested Monday by agents of the Federal Bureau of Investigation and Kingston Police on a federal charge of mail fraud related to making false and fraudulent mortgage and loan appraisals during a four-year time period. Marino stated that Richard Woods, age 51, was charged in an indictment returned by a federal grand jury on March 20, 2007, with using the mail to further a scheme in which false real estate appraisals were used to qualify customers for inflated mortgages. The indictment states that Woods provided false real estate appraisals to Four Star Mortgage Services, First Advantage Financial Corporation, and other companies during 1999-2003.       Colorado appraiser surrenders licence after investigation of 8 appraisals
      In a press release the Colorado Division of Real Estate announced that the Board has alleged that Pueblo appraiser James Esters overvalued eight Pueblo properties. The Board assessed a $24,000 fine. Mr. Esters agreed to permanently surrender his appraiser license and pay $7,500, the balance of the fine becoming due should he attempt to reapply for licensure. Overvaluing property contributes to the state’s rising foreclosure rate. “We will aggressively pursue appraisers who demonstrate a pattern of overvaluing properties,” said Erin Toll, Director of the Division of Real Estate. “We will be taking a particularly close look at valuations in Greeley and Pueblo, counties with extremely high foreclosure rates.” In the Final Stipulation (Order) for this case order the Board looked at 8 properties: 2681 Emilia Street, Pueblo 1230 Elm Street, Pueblo 1800 E. The Division sought and obtained a temporary restraining order (TRO) against Virgin on May 15, 2007, which restrained him from engaging in appraisal practice. The verified complaint and motion for the TRO was brought on the Division’s behalf by Ohio Attorney General Marc Dann’s office. Prior to a preliminary and permanent injunction hearing, Virgin permanently surrendered his license on May 25, 2007 in a settlement agreement with the Division and agreed to never apply for reinstatement of that license or any other appraiser license, certification or registration in Ohio.       Former Oklahoma appraiser sentenced to 1 year in prison
      KTEN News in Oklahoma  is reporting that former real estate appraiser Lawrence Goodwin has been sentenced to one years imprisonment and order to pay over $235,000 in restitution. Goodwin had filed a guilty plea in June 2006. Court records show that on May 19, 2006 an Information was filed in the District Court for the Western District of Oklahoma charging Goodwin with providing a fraudulently inflated appraisal on a property at 1713 Eagle Nest, Norman Oklahoma which was supplied to the branch manager (name not known but referred to as C.A.R in the information) of the Norman office of Wells Fargo Financial. C.A.R’s employment was terminated by Wells Fargo Financial on or about January 14, 2003. On or about March 3, 2000 Goodwin’s lost his Oklahoma’s appraisers license but continued to provide appraisals to financial institutions until about July 10, 2002.
