I was talking to Jonathan Dalton on the phone about the people appearing in some of the Bad MLS Photo of the Day posts. He pointed out that having people appear in MLS photos are a violation for his MLS.
Actually it’s the same thing in Connecticut, and I suspect the majority of other MLS’s. Likely for simple reasons of the fear of lawsuit of people not having signed model releases etc. Plus the very obvious fair housing concerns come to mind too.
So not only are the agents putting photos of people in listing photos destroying the photo as a sales piece, they’re willing to risk some hefty fines to do so.
It’s so mindlessly inept, that I can’t dwell on it too long.
I just post the silly photos, laugh and move on.

As if being investigated by the FBI back in March and getting busted trying to buy their reputation back in May wasn't enough, Beazer Homes is in trouble again. This time, it's with the SEC and the U.S. Attorney's Office who are investigating Beazer Homes for violations of HUD regulations governing down-payment-assistance programs. This comes after a series of stories in the Charlotte Observer came out documenting cases where Beazer Homes appeared to have broken rules governing down-payment-assistance and had sold homes to low-income buyers who couldn't afford them in the first place.
Beazer admitted that it's own internal investigation found evidence that employees of Beazer's Mortgage division violated certain HUD regulations dating back to at least 2000. The company is seeking to negotiate a settlement with regulators to the tune of $8M to $15M, but no deal has been struck as of yet.

I know I’m constantly showing bad real estate photos on the blog. I’m enjoying mocking and spinning them into something humorous. But at the same time I’m also more than a little disgruntled about them.
I’ve been tossing and turning about this for a couple weeks now. I’m getting to the point where I think that because bad photos act to drive potential buyers away from asking for showings and writing offers, that bad photos are in fact a serious ethical violation by listing agents. One that should or could result in lawsuits, fines, revoking of licensure.

An Anchorage Salvation Army thrift store has agreed to pay a $76,906 penalty to settle with the U.S. Environmental Protection Agency (EPA) for alleged violations of the asbestos National Emissions Standards for Hazardous Air Pollutants (asbestos NESHAP) under the Clean Air Act.In response to customer complaints, EPA conducted an inspection of a thrift store operated by the Salvation Army in Anchorage in September 2005, and found untrained workers removing over 7,500 square feet of asbestos-containing floor tile during business hours.
