The Ninth Circuit heard oral argument on April 14, 2008 in Theme Promotions v. News America Marketing, 06-16230– a case I discussed in a recent post. An audio file of the oral argument is available here.News America Marketing appealed the lower court's finding of antitrust violations, arguing that the right of first refusal ("ROFR") provisions in its contracts with consumer goods companies were pro-competitive. News America suggested that the ROFR's allowed News to offer volume discounts to consumer goods companies, and pointed out that pricing declined during the relevant time period. The court expressed skepticism, and quoted an internal News America memorandum that suggested that News' enforcement of its ROFR agreements to prevent Theme Promotions from placing its ads with Valassis h
The California Court of Appeal, 1st District, recently rendered a crazy decision in Lambert v. Carneghi that could open the door for lawsuits by a litigant against their expert witness in situations where the expert's testimony harms the client's case....
Eyewitness testimony, which relies on the accuracy of human memory, has an enormous impact on the outcome of a trial. In criminal cases, eyewitnesses frequently play a vital role in uncovering the truth about a crime.
The evidence they provide can be critical in identifying, charging, and ultimately convicting suspected criminals. However, eyewitness testimony is [...]
In what could be considered the first major judicial opinion on workplace bullying, the Indiana Supreme Court, in Raess v. Doescher, permits an expert witness to opine on "workplace bullying."
Joseph Doescher, a hospital operating room perfusionist (the person who operates the heart/lung machine during open heart surgeries), sued Dr. Daniel Raess, a cardiovascular surgeon, for an alleged assault in the operating room. The testimony at trial was that Dr. Raess was angry at Doescher about reports to the hospital administration over the doctor's treatment of other perfusionists. Dr. Raess aggressively and rapidly came at Doescher "with clenched fists, piercing eyes, beet-red face, popping veins, and screaming and swearing at him." Doescher backed up against a wall to defend himself, believi
His name was John Bradley Morrison. I first met him early in 2004 at a morning bible study hosted by Pastor Ken Smith of Heartland Church in Brownwood, Texas. Brad was handsome, charismatic, funny and had an infectious smile, the kind of gentleman you hoped to know better. I sensed that somehow our lives were going to be connected in some way, little did I know just how much.Just days before Brad walked into Heartland Church, he introduced himself to Pastor Dawn and told her of his past. Brad said to her, “I want to know God, am I in the right place?” She said, “You’re in the right place and you’re not the first.” Brad’s past mistakes troubled him and caused him great pain in his life.I wanted to see Brad hook up with us in our bible study and win in Christ and he did just th

I tried watching this on TV but watching the blowhards in Congress incessantly drone on in sound bites like "rainman" just is too much for a human to be expected to bear. I can't be expected to "take one for the team" every time these guys decide to put on the dog and pony show.
That being said, I decided to read in quiet...

About 4 months before the Korean Airlines Boeing 747 flight #KAL007 that Congressman Larry Mcdonald was riding in was shot down by the Soviets supposedly because it "strayed into Soviet air-space", he gave an extremely revealing interview with Pat Buchanan and Tom Braden on their talk show called Crossfire. In this video taped interview Congressman McDonald reveals that there has been a "conspiracy of the elitists" for the last 40 years. Of course we know that its been going on for a lot longer then that.Personally I do not believe the Government's or the Media's report that the plane "strayed into Soviet air-space". I believe that the Illuminati plotted to deliberately shoot this plane down because they knew Congressman McDonald was on-board. Sacrificing all others on-board to get at

Stern Testifies In Smith Inquest -
By TOSHEENA ROBINSON-BLAIR:
Nassau, Bahamas -
A close friend of the former US reality TV star the late Anna Nicole Smith not only recounted the final hours of the celebrity’s 20-year-old son’s life while on the witness stand Tuesday, but also refuted previous testimony that he possibly got rid of evidence.
California attorney Howard K. Stern was the last witness to take the stand in the Coroner’s Inquest that began in November, but was delayed while the court tried to secure testimony from American witnesses – who are not compelled to come to The Bahamas to give evidence in the matter.
On the witness stand Tuesday, Mr. Stern described the young man as a good person, even though his mother sent him to live with caretaker Raymond Martino after

Barry Bonds' testimony was finally revealed on Friday, after nearly five years since his December 4, 2003 testimony. The player is currently facing perjury charges, and his 5-year-old testimony could become part of the case if Bonds is to go on trial.According to the testimony, Bonds says he had never knowingly taken performance-enhancement drugs, and pleaded not-guilty, but now faces perjury charges. The player, who is now a free agent and is still looking for a team for the 2008 season, said the creams and lotions prosecutors said to be steroids were just something his trainer gave him to relief pain. What the prosecutors are now trying to determine is whether Bonds was indeed not aware of taking performance-enhancing drugs, or was he trying to cover up for his friend and trainer Greg And

Jankiel Wiernik was a master builder and he along with others built many of the structures in Treblinka, which he described at the Eichmann trial in Jerusalem in 1961:
“When I came there, there were only three gas chambers. The large kitchen was not there yet. I constructed various barracks, I built the guardroom. I built the door, the entrance gate.”
He described the arrival process:

Jonathan Gregory Hoffman was convicted and sentenced to death in Union County in 1996, based in part upon the testimony of a root doctor who claimed he sold Hoffman a magical charm that would keep him from getting arrested. (For those not from the Deep South, a root doctor or rootworker is a sort of folk healer/magician.) Hoffman was given a new trial in 2004 because prosecutors Kenneth Honeycutt and Scott Brewer failed to reveal that rewards were given to their star witness in exchange for his testimony. That witness has since recanted his testimony, so in retrying Hoffman, prosecutors want to use the old statements of the now-deceased root doctor. Trouble is, prosecutors didn’t turn over evidence that he, too, was seeking a reward.

This is my 100th post on Testimony of Spade and as it is a special occation this post does not concern archaeology, or at least not prehistoric archaeology. Last weekend I visited a museum that has bit more modern touch: the Swedish Air Force Museum in Linköping.
Though my interest normally lies elsewhere I have to say it is a nice museum. We began our visit with the Jas 39 Gripen flight simulator which was a lot of fun. During the simulation I low sniffed over the island Visingsö at approximately 100 ft. The maps are made out of satellite pictures which allow a rather good resolution. It was a fun experience and we got a lot of interesting information by the guide.
The museum is constructed on an old Swedish army flight base F3 (1926-1974) with, obviously, a lot of army aeroplanes; this is not my favourite part of the exhibit. Most interesting are the displays that tell stories, for example:
The display of DC 3 that was shot down in 1952 by Soviet fighters over international water

Day 23 for 5th October, coinciding with Ramadan 2007 / 1428
Soon after coming to faith in Christ Bokar told his Christian friends that he wanted to do away with a special undershirt, inscribed with Koranic passages and interwoven with dozens of amulets. Several Mauritanians were afraid and said the shirt could not be destroyed, that if burned, it would jump out of the fire. This type of shirt makes the wearer impervious to any weapon. It is one of the most powerful enchantments known to the Hal-Pulaar (Fulani). After much prayer, Bokar burned his iron shirt, and the result was tremendous spiritual growth in his own life. Many who heard of the incident gained a new respect for the power of the Gospel.
Independent from France in 1960, Mauritania has suffered from a succession of military coups and ongoing tribal conflict. A severe drought over the past decades has devastated the country. In 1957, a small fishing town called Nouakchott was chosen to be the capital of the new country. N

An Indonesian couple from a Muslim background invited some Christians to help them with their business. The Christians eventually began to share their beliefs with the Muslim couple. The husband and wife came to faith and even began to have Christian gatherings in their home.
Later there was strong opposition from the village leader who forbid the couple to see the Christians. The couple’s business of marketing rice suffered. Soon no one wanted to buy rice from them and their faith was really put to test. The wife’s faith was strong and she believed that God was going to help them. The next month the wife sold rice as she had never done before; the couple made more profit than in many previous months! They experienced God’s faithfulness!

I love reading testimonies from other Christians.
Because nothing is more real and inspirational than reading about how God has worked miracles in someone’s life, turned it around, made it better or how they themselves overcame trials and tribulations in their lives.
Some think that their testimonies are nothing to shout about, but my belief is that no matter how mundane you think it is, your testimony shows just how God can work in anyone’s life.

I came across this video quite by accident, and it is simply amazing because it is just so inspirational.
I would strongly urge you to watch all 20 minutes of it, and see for yourself how a whole tribe believed unto salvation! It truly is awe-inspiring the belief and faith that God had put into the hearts of these people whom we will by our industrialized and “enlightened” societies call primitive and uneducated.
Watching it really reminds me of 1 Corinthians 1:19-25 (KJV).

Look no further for evidence of the human brain’s astounding capacity to recover and adapt to events that would normally be incompatible with normal life.
A 44-year old French civil servant went to the hospital after he suffered mild weakness in his left leg. Once the doctors learned of his past medical history, which included having a shunt inserted into his skull to drain away water on the brain as an infant, they performed a CT scan and an MRI of his brain.
To their amazement, they found that his lateral ventricles were massively enlarged, leaving but a sliver of brain tissue. Normally, these ventricles are tiny chambers that hold the cerebrospinal fluid that cushions the brain.
Intelligence tests showed he had an IQ of 75, which, although below the average score of 100, is not considered disabled or mentally retarded.
Dr. Muenke, a pediatric brain defect specialist, commented, “If something happens very slowly over quite some time, maybe over decades, the different parts

My husband just got home from traveling to conferences the last two weeks. One day in the spring of 2002, life was going along pretty much as it had been. I was riding around town with my friend Royce, which was not unusual. However, the reason I was with Royce this day was a little unusual. Several days prior, Royce had an “experience” and had suddenly become very religious and had been acting extremely odd. Royce had plenty of friends in his life, but none of them seemed too willing to spend any time with him at this point. Royce, in my estimation, had always been a pretty good friend to me, and so I decided it would be decent of me to spend some time with him regardless of how odd he was acting. It is probably necessary for me to interject at this point a bit of my past. At 11 years old my life took a grim turn after my parents divorce. I turned inward and pushed everything else out. Drug use came not long after that and became my best friend for years, being the one I could reliably turn to for an escape from this life. After moving around the country

No Christian website is complete without a testimony. In particular, when it comes to an apologetics website such as this one, many people probably wonder about the site owner's background. So why did it take me eight years to put one up? No idea. I just happened across an article on the subject on rationalchristianity.net today, which I had actually read before, and decided to get to it.

From cave drawings, to picture books, to a ghost tale spoken in hushed tones around a campfire, human beings are always interested in a good story. We begin to truly communicate when our stories have pictures that our audience can see or imagine. It is how we empathize, which is the highest form of listening.
The reason I’ve been thinking about all of this is because of the recent testimony by Deputy Attorney General James Comey, and the impact it’s had on the Alberto Gonzales attorney scandal. Comey’s testimony took an experience that doesn’t conjure up mental imagery—a constitutional crisis of the highest order—and transformed it into a universal image. After all, who can’t imagine an older man, sick and slightly disoriented in his hospital bed, with two able-bodied (and perhaps ill-intentioned) men bursting through the door? That’s certainly much easier for the average American to envision and develop an emotion around than abstract concep

After hours of testimony in which he answered all of the Senators' questions and provided thousands of pages of documents, he again showed that nothing improper occurred. He admitted the matter could have been handled much better, and he apologized for the disruption to the lives of the U.S. Attorneys involved, as well as for the lack of clarity in his initial responses. Patrick Leahy (D-Vermont) opens the Alberto Gonzales hearings before the Senate Judiciary Committee, on April 19, 2007. Patrick Leahy addresses the crowd about the purpose of the hearings. Leahy stats that the purpose of the meetings is to determine the reasons of the dismissals of the eight U.S. attorneys and to determine if the firings were political or not. "If the White House did nothing wrong than prove it. If nothing to hide then the White House should stop hiding it. Quit claiming the emails cannot be produced. ...Show us the documents," Leahy said. Senator Kohl (D-Wisconsin) questions Gonzales about possible voter fraud in Wisconsin and why that U.S. attorney was not fired for not prosecuting those cases. Senator Jeff Sessions (R-Alabama) questions Gonzales about recess appointments of U.S. attorneys and Patriot Act revisions.

The Democrats have delayed Alberto Gonzales’ testimony in the made up controversy that is the US attorney firings. The white house had wanted to move the hearings up to get them over with. The Democrats denied that request. The white house knows he did nothing wrong, so they want to put it in the past and get on with business. Now they have delayed the original date.
The reason I believe they did this was to drag out the trumped up controversy. They know no wrong act was committed here, they have even admitted it. But they know that Americans who don’t pay close attention to politics will be listening and they hope to make them believe criminal activity took place here. The longer they can drag this out, the more they believe it hurts the president, and that’s the true goal.
The Democrats are in no hurry to show the country nothing wrong happened here, they are just interested in making the administration look bad.
Here is a YouTube Video of Kyle Sampson testifying before Senator Patrick Leahy (D-Vermont). Kyle Sampson is the former chief of staff to Attorney General Alberto Gonzalez. Representative Joe Barton (R-Texas) attacks Al Gore at House Committee testimony on March 21, 2007. Joe Barton represents an area of Texas with strong oil and manufacturing interests. Joe Barton tells Al Gore he is "totally wrong" on certain aspects of global warming. Dennis Hastert (R-Illinois) told Al Gore that same day that he believed the debate over global warming had been settled. This was coming from the former leader of the Republican Party in the House. Joe Barton is obviously wrong and science has agreed unanimously that the debate has been settled on global warming. Dennis Hastert even agrees with this. Watch for yourself and see the disrespectful tone and manner that Barton treats the former Vice President.

Bush’s reason for not wanting to have his aides called before congress was that he did not want the people working for him to have to worry about the kind of advice they give him bcause they might be hau
