Tenth Circuit Upholds Grocery Stores’ Gasoline Discounts Tied to Food Sales
Discounts Upheld - Reversing the district court, the Tenth Circuit Court of Appeals held on April 25 that a supermarket can sell gasoline below cost under Colorado law when the sale is contingent on purchasing groceries above cost, and the price of the total bundle is above cost. See Parish Oil Co. v. Dillon Cos., No. 07-1032, 2008 WL 1837228, __ F.3d __ (10th Cir. 2008).Defendant Dillon Companies, a subsidiary of Kroger, operates grocrery stores that include retail gasoline filling stations on the same premises. The stores offered discounts of up to 20 cents a gallon when customers satisfied minimum purchase requirements from the grocery stores. The profit margin on qualifying grocery sales, in the aggregate, exceeded the discounts. Colorado Unfair Practices Act - Competing gas stations i

Why we have a Tenth Amendment
Guest Commentary by Dan Reale You can ask anybody what the first amendment prevents infringement upon. They might know about one thing, freedom of speech, but incorrectly, tell you we are granted freedom of speech. Even then, most miss the other four inalienable rights the Constitution limits the federal government from violating. Most are equally unaware of [...]

Phoenix, Arizona Alcoholic Anonymous: The Tenth Step Promise
(Working the Step)This thought brings us to Step Ten, which suggests we continue to take personal inventory and continue to set right any new mistakes as we go along. We vigorously commenced this way of living as we cleaned up the past. We have entered the world of the Spirit. Our next function is to grow in understanding and effectiveness. This is not an overnight matter. It should continue for our lifetime. Continue to watch for selfishness, dishonesty, resentment, and fear. When these crop up, we ask God at once to remove them. We discuss them with someone immediately and make amends quickly if we have harmed anyone. Then we resolutely turn our thoughts to someone we can help. Love and tolerance of others is our code.(The 10th step Promise) And we have ceased fighting anything or anyone, even alcohol. For by this time sanity will have returned. We will seldom be interested in liquor. If tempted, we recoil from it as from a hot flame. We react sanely and normally, and we will find th

Letitia is the tenth celeb to leave Strictly Come Dancing
Source: BBC Last night our remaining couples each had to perform two dances - a Ballroom dance and a Latin dance. Gethin and Camilla ended up in first place, just one point ahead of Alesha and Matthew on the judges’ scoreboard, while an attack of nerves left Matt and Flavia in fourth place. After some stunning displays from the professionals, including a sizzling Argentinian Tango to Armando Punturero’s Los Amigos by Vincent and Flavia, a performance to a Rocky Medley by the World Latin American Formation Champions, and a song from Cliff Richard, the fateful moment came. Who would be dancing for survival once the public votes were counted? Bruce and Tess revealed the names of the couples who were safe, leaving Alesha and Matthew and Letitia and Darren to fight for survival. Alesha and Matthew danced their Viennese Waltz again, followed by Letitia and Darren also giving their Waltz a second spin. Once they’d done their best to stay in the competition, the ultimate deci

      Imagining the Tenth Dimension
I’ve always been fascinated by the 4th dimension and beyond, especially being a big fan of Michio Kaku and his books. So you can imagine my excitement when I came across Rob Bryanton’s book called Imagining the Tenth Dimension: A New Way of Thinking About Time and Space. This video (from Rob’s website) simplifies the multi dimensional theory in an almost cartoonic way. Just a note, it’s 11 minutes long. It’s a feat in itself to concise what has baffled scientists for generations in 11 minutes and getting the point across (without being too technical). Great stuff! Share This

      Understanding The Tenth Dimension
Imagining the fourth dimension is hard but 6 more dimensions after that is completely mind boggling. Very interesting though. This is a concept that was thought up by scientists involved with string theory research. None of this is proven it’s just a theory. Granted it’s an amazing theory, but still just a theory. Warning: People with weak minds should not attempt to watch this video without some sort of supervision. In the Tenth House
I didn't make my salon appointment today; I had to reschedule for tomorrow. I'm having a massive flare-up of my RA, so I'm spending the day in bed reading, or at least I'm trying. My body needs the rest, but my mind sees clutter in the house and wants to do something about it. I'm compensating by blogging, at least then I'm doing something. Doogie and Mia spent the afternoon playing in the sprinkler outside. The weather is beautiful today. Another ferocious storm blew over us last night. We got hit with 1/2" hail and 60+mph winds. The winds from a storm earlier this week broke my new windchimes. This is the kind of weather I love: mid-70s and sunny during the day, colorful and loud storms at night. I'm joining a new blogging community called wismoms (Wisconsin Moms). I'm not sure of the format yet, but I'll give more details as I get them.In the Tenth House by Laura Dietz is a literary thriller full of twists and turns. I love the contrasting orange on the collar and sleeves.

The Tenth Annual ChessCafe Holiday Quiz
The hardest quiz in the world of chess made its annual appearance today*: scroll down for the questions. You'll have to scroll quite a way - the section describing the prizes is even longer than the quiz itself. Come to that, in this particular quiz the list of prizes is usually longer than the list of completely correct entries. Substantially longer. So, while we could all pretend to have a go at it ourselves, and be lucky to get one or two correct, I would propose, in the spirit of the Kasparov v The World chess game, that we pool our resources and try and get as many answers as we can between us, much as people do with the King William's General Knowledge Paper. After which the only question will surely be - what to do with the prizes?I would start off, but at first glance I don't think I know any of the answers at all.So...who does?[* = this link may become defunct in which case I'll try and update it]
