      Sales Tax Monies....Better Use?
      Hmmm, thinking that our infrastructure might be better served by that increase in sales tax monies. A day like today that saw most of NE Ohio flooded due to sewers that are tied into each other in ways that encourage flooding.....couldn't they use that money to take care of this issue instead?       Alabama Statewide Sales Tax Holiday

      Cindy Locklear Explains Her Sales Tax Vote
      While I can sympathize and understand Cindy Locklear’s vote on the extension of the 3/4% sales tax, I can’t condone voting for it.  Rationalization and placing the blame on mandates from the State of New York do not cut it anymore. Paring down a budget is never an easy or pleasant task, whether it is a home, business or government budget.  Generally it is a painful process.  The problem with the Erie County Legislators, and Joel Giambra, is that they are trying to cope with the problem without causing any pain.  It just won’t happen. It is time to draw a line in the sand and say “NO MAS”!  People will be subjected to less services, possibly some inconvenience and possible pain.  That is when the pressure can be put on the State to make some changes to alleviate the pressure on the County budget.       Sales Tax Liability Can Not Be Disallowed If State Govt. Considered It As Deemed Collected !
      Advanced TopicAn assessee had been allowed sales tax claim u/s 43B pursuant to a scheme of the state government whereby the government had converted his sales tax liability into a loan. The CBDT had issued two circulars---No.496 in 1987 and 674 in 1993---to provide that in cases where incentives were granted to an assessee by way of sales tax deferment, payment of ST will be deemed to have been made and no dis allowance will be made u/s43B.The assessee had been allowed such a deduction in A Y 1994-95, when his unpaid ST was converted into a loan.The loan instalment was due to be paid before31.03.2006, but it was not paid even before 31.10.2006, the due date for filing return of income.Now the AO seeks to disallow this amount of loan instalment treating it as part of sales tax.My understanding is that once the amount of unpaid ST was converted into a loan, it ceased to be an expense altogether. How can it acquire the colour of sales tax again? Isn't the AO violating the CBDT circulars

      Even Service Tax or Sales Tax Is liable to TDS!
      Whether TDS has to be deducted on the Gross amount of Bill, inclusive of service tax and sales tax if any. Are we supposed to deduct tax on tax i.e. service tax agarwalrohit_k@............com The word used in TDS provision is "Any sum" , therefore all sum whether service tax or sales tax, TDs has to be ducted. The basic premise is that the person's whose income has been deducted shall get the credit for it on showing the said Service tax and Sales tax to the credit side of the P &L account. Therefore, a person liable to deduct tax at source is required to deduct on Gross amount of payment without giving a thought on the nature of payment.
