If you file an internal complaint at your company alleging that you are the victim of harassment or retaliation, your employer is supposed to inform staff that it will not accept you being subjected to any mistreatment, while your complaint is being investigated. In addition, any employment decisions that are made, after you file a complaint, should be reviewed by your employer in order to ensure
When a company is caught making a bad employment decision, they come to us, their lawyers, to bail them out. Bryant v. Dollar General Stores (6th Cir. 8/15/08), presents one such example. Dollar Stores fired Martha Bryant, who testified that her supervisor told her she was being fired "[b]ecause of your health, I don’t think you can do the job." Faced with what one can safely cal

WASHINGTON (AP) _ The Supreme Court sided Tuesday with employees who faced retaliation after complaining about race and age discrimination in rulings that drew support from conservative and liberal justices.
The court, by a 7-2 vote, said a provision of the Civil Rights Act of 1866 covers claims of retaliation that follow complaints about discrimination on [...]
Last December, I asked the question, "How far to the right has the Supreme Court swung?" This morning, the U.S. Supreme Court issued 2 decisions that suggest that it might not have gone as far to the right as first thought. Each of today's cases expands the scope of retaliation claims under federal employment discrimination statutes. In each case, the Court went beyond the plain language of the st

Mahathir had quited UMNO. He also openly admit it's a move to oust Abdullah. Some see it as a shocking move by the Malaysian ex-PM. But I am not taken aback at all by his latest plot. I utterly agree that Mahathir has become very unbecoming lately and he

Workplace retaliation is illegal under Title VII, which contains anti-discrimination, anti-harassment, and anti-retaliation provisions. The questions, listed below, come from the EEOC and provide you with an idea of the kind of questions an investigator will be contemplating, in the event you file a complaint of workplace retaliation. These are just some of the considerations that would be part of a formal complaint:1. Did the employee oppose discrimination in the workplace? (retaliation based on a complaint of discrimination)a. Did the employee explicitly or implicitly communicate to the employer or another covered entity a belief that its activity constituted unlawful discrimination under Title VII…?b. If the protest was broad or ambiguous (an employee didn’t

Another day, another retaliation case out of the 6th Circuit. In Cline v. BWXT Y-12, LLC, the company declined to hire Cline, a former employee, for an open position because the company was "in litigation with Mr. Cline and that he may not be the best person ... because of the litigation factor." That litigation involved a claim of age discrimination. The decision makers testified that while they knew of the litigation, they did not know that it involved allegations of age discrimination. The district court threw out the retaliation claim on summary judgment, finding that because the decision makers did not have "any knowledge of the substance of Cline's present suit," they could not have known that he had engaged in protected activity.
The appellate court disagreed, and found that becau
The 6th Circuit continues to broaden the scope of retaliation claims, and in the process make it more and more difficult for employers in Ohio, Michigan, Kentucky, and Tennessee to manage against these claims. In Hawkins v. Anheuser-Busch, the 6th Circuit recognized a claim against an employer for retaliatory acts committed not by a manager or supervisor, but by a co-worker. Yesterday, the Court continued its expansion of retaliation liability and recognized liability for "associational retaliation."
Section 704(a) of Title VII of the Civil Rights Act of 1964 prevents retaliation by employers for two types of activity, opposition and participation:

Cunningham v. Steubenville Orothopedics & Sports Medicine, Inc., decided this week by Ohio's 7th Appellate District, illustrates the pitfalls that await companies that terminate employees in the midst of a workers' comp leave. It also shows that managers and supervisors must be vigilant in what they put in writing.
Marianne Cunningham was an x-ray technician for Steubenville Orthopedics. She injured her back at work and took a six-week leave of absence after filing a workers' comp claim for her injury. After informing Steubenville Orthopedics that she would be able to return to work the following week, she wa
When it comes to being targeted at work, there are many different ways to define what is happening in the office. Some people may argue that they are being subjected to a problem related to systemic discrimination on the job (e.g., Blacks have been historically denied promotions, almost without exception), some people may argue harassment (e.g., a hostile and offensive environment due to racial prejudice), and some people may argue retaliation (e.g., they made some sort of informal or formal complaint, which resulted in the complaining employee being targeted at work). Each situation is different because people and workplaces are different. One racist coworker or a company promoting racism is going to be different from the next, even though there may be some similarities in the excuses used

This is how far employers will go to protect their right to target and terminate complaining employees…The case in question is CBOCS West Inc. v. Humphries. CBOCS West Inc. runs the Cracker Barrel chain of restaurants. The case raises an issue that remains unresolved in the Civil Right Act’s (1866) nearly century and a half of history: does the Act’s first section, now codified as 42 U.S.C. 1981, guaranteeing equality in the right to make a contract, forbid reprisals against an individual who complains of discrimination against others.Cracker Barrel Restaurants has filed an appeal to the Supreme Court, in which they are essentially arguing that Federal anti-discrimination statutes do not protect employees from being fired for retaliatory purposes under U.S.C. 1981. To state this plai
Ron Paul has come under criticism for a recent comment. I believe this started at Free Republic, but it is now being mentioned on several conservative blogs. The claim, based upon taking a portion of the response in the video above, is that Paul said, “A president has a responsibility to, uh, you know, retaliate against an attack. I don’t think there’s been a good example of a need to do that throughout our whole history.”
Viewing the actual video clearly shows that this misrepresents Paul’s view. The actual question dealt with first strikes, as opposed to retaliation, but Paul did stray from this specific question. Paul included his views that Congress should declare war as called for in the Constitution as opposed to the president deciding to attack. Paul went on from that point to speculate that theoretically a situation could arise where immediate retaliation would be necessary and it wouldn’t be possible to get a declaration of war from Congre
I blogged about road rage before. But today I almost feel victim to my own desire to flip out and retaliate. Here is how.
I am riding in my lane earlier today when a black Mustang merges not more than 5 feet in front of me and slows down. I slow down too, go around him and look at him shaking my head, basically letting him know of what he just did. And the driver basically starts aggressively cussing me out. I get pissed immediately. What do I do? If I was driving I’d have the option of getting in front of him and subsequently slowing down to a crawl speed. I can’t do that on a motorcycle. I have heard about the riders throwing coins at drivers like that and speeding away. As I am contemplating my retaliation I see a couple of ambulances on the side of the road. It is a rider down situation. The rider seems to be fine though, his motorcycle not visibly damaged. Clear sign for me. I should abstain from retaliation. I get to be an adult in this situation. Slightly fuming over
If you are under attack at work, it’s critical that you have a complete and thorough record of every action taken against you by a supervisor, manager, coworkers or your employers--as a whole. You should also have a record of performance evaluations and other performance-related feedback, policies contained in the personnel manual, and other information. When it comes to compiling evidence that supports your claims of workplace mistreatment and abuse, you should think in terms of direct vs. circumstantial evidence. Direct evidence is the best evidence to have because it is the most blatant and undeniable form of proof. An example of direct evidence is being told that you are not being promoted because you are Black or having your boss give you a memo stating that you won’t be given an opportunity to manage other staff because of your race. Direct evidence involves someone making it blatantly clear that your race is one of the factors or the sole factor in how they are treating you i
All Conservatives/ Libertarians should read the liberal blogs from time to time. In order to make a valid argument for Conservatism, you must understand the other side. This is true even if the other side is devoid of any rational thought. I digress.
As many of you know, I often read the Huffington Post and Media Matters to point out when they are blatantly lying to their own constituency. ...

The Iranian government warned Israel that any attack upon its territory would result in an Iranian air and missile bombardment of Israel. Spokesperson Gholam Hossein Elham said Israel and the world will be provided further information on Iran’s plans on October 12– the last Friday of Ramadan which is now known as “Qods Day”– a day on which to protest Zionism. Deputy air chief General Mohammad Alavi told the Fars news agency, “We have drawn up a plan to strike back at Israel with bombers if this regime(Israel) makes a silly mistake.” He also said Iran now possesses an upgraded version of the Shihab-3 missile which has a range of 1,200 miles. General Alavi warned the United States, “Now we possess the necessary systems to confront them(cruise missiles).” The Fars news agency turned down AP requests for a tape of the general’s comments.

Friday during expressions of love for all mankind Provisional Tehran Friday Prayer Leader Ayatollah Mohammad Emami Kashani during the weekly Friday Sermon said of the U.S. in Iraq: ‘"The only important point for the US statesmen is that 4,000 US soldiers have got killed in Iraq, not caring a bit about the huge number of the innocent Iraqis that have got killed at home due to the US arrogant policies."’ Today, in the interest of peace and reconciliation, President of the Islamic Republic of Iran Mahmoud Ahmadinejad offered these dove-like remarks: '"They realize that if they make such a mistake the retaliation of Iran would be severe and they will repent.
