The Arizona Republic reports that a state panel will soon consider clemency for 78-year old Max Dunlap who was convicted for the 1976 murder of Arizona Republic reporter Don Bolles. Bolles died 11 days after a bomb exploded beneath his white Datsun (now enshrined in a museum dedicated to journalism) and Dunlap was believed to have hired two men to do "the job." In his clemency application, Dunlap says that he does not expect to live long, that he is "truly sorry" for his involvement with the other suspects in the crime and that he is "sorry for the newspaperman."See story here.

Gov. Haley Barbour (R) rejected Earl Wesley Berry’s request for a reprieve last fall. Now Mississippi Attorney General Jim Hood has set an execution date for May 5. Berry was convicted for the brutal 1987 murder of Mary Boundsawyers and his lawyers are now seeking a stay of execution from the Governor. In this post, PardonPower related the details of the story of Jason Charles Yaeger who is finishing up the last year of a four-year sentence in a minimum security federal prison camp. Yaeger was seeking clemency from President Bush so could be with his 10-year old daughter who was dying of brain cancer. I noticed Bill O'Reilly was talking about the case the other night as well. Previously (here) PardonPower reported on the case of one Charles Fackelman who was sentenced to more than five years in prison on four felony charges for pulling a gun on a man - Randy Krell -and kicking in a neighbor's door while pursuing him. The incident occurred after Krell participated in a car chase that led to an accident that killed Fackelman's 17-year-old son. As Krell was given only a six-month sentence, supporters of Fackelman have initiated a petition asking Gov. Jennifer Granholm (D) to commute his sentence. Now Circuit Judge Joseph A. Costello Jr. is responding to criticisms of his decision making in the case. Costello says that he was bound by the law and, as a result, the sentence was proper. The chairman of Louisiana's House Judiciary Committee, Rep. Cedric Richmond has announced that his committee will hold hearings on what is known as the "Angola Three" case and he is calling on Gov. Bobby Jindal (R) to pardon the men involved. Rep. John Conyers, D-Mich, the chairman of the U.S. House Judiciary Committee, has also recently met with two of the three who remain in prison. The men - Robert King, Herman "Hooks" Wallace and Albert Woodfox - say they are victims of cruel and unusual punishment because of the time they spent in solitary confinement. A lawsuit is also pending in federal court. Wallace and Woodfox also say they were wrongfully convicted in a guard's death. King's conviction for killing another inmate was overturned, and he was released in 2001 after 29 years in solit

Amnesty International USA is protesting the 4-3 decision of the Georgia Supreme Court to deny a new trial for Troy Anthony Davis, who was convicted of the murder of a Savannah police officer in 1991. Davis has been on "death row" for 16 years, long enough for 60,000 people to sign a petition on his behalf. It is argued that he was convicted solely on the basis of witness testimony and that seven of nine non-police witnesses have recanted or changed their testimony. Amnesty International also claims the case featured a questionable police investigation, a lack of funding to ensure adequate defense and thwarted attempts to present new evidence in the case. The human rights organization is now calling for the Georgia Board of Pardon and Paroles to commute Davis' sentence. See story here.

Gov. Bill Ritter (D) will be asked to commute the 48-year prison sentence of Clarence Moses-El, or grant a pardon. Moses-El was convicted of rape in 1987 although there was no physical evidence. The victim is said to have named three other suspects before telling prosecutors that her attacker's identity came to her in a dream. In 1995, Moses-El gathered donations from fellow inmates for a DNA test only to learn that the Denver police had thrown what evidence they had away! The "DO NOT DESTROY" labels were ignored. Sen.
