Apparently, a trio of judges in a Dutch court ruled that it didn't have jurisdiction to rule on the phone maker's claims outside of The Netherlands, thus, the patent-licensing case against Qualcomm was dismissed. Aside from claiming that its "jurisdiction was limited," the court also stated that Nokia's gripe was "too broad to give a reasoned decision." Of note, a German court also dismissed the case just last month on "similar grounds," but if you were counting on Nokia to just take the news in stride, we doubt you'll be pleased to hear that it's already "considering if it will appeal the decision." The International Trade Commission (ITC), a federal agency, has banned imports of any new phones made with Qualcomm chips because they violate a patent held by Broadcom. The ban does not apply to the iPhone because Apple decided to not include third-generation (3G) cellular data networking technology in the iPhone. The ITC found that Qualcomm had infringed on patents owned by Broadcom last October, but until present it was relatively unclear what sort of action would be taken.

Según TG Daily Broadcomm dice que la fabricante de procesadores para telecomunicaciones ha cometido fraude, ocultado patentes e incumplido términos de licencia. La denuncia fue impuesta en el día de ayer en California, condado de Orange.
En un comunicado de prensa, Broadcom asegura que Qualcomm ha intentado beneficiarse de las patentes incluso después de haber perdido varios casos por infracción de las mismas contra Broadcom. Broadcom advierte que Qualcomm ha infringido la ley con múltiples tecnologías y estándares, como los de la telefonía móvil, vídeo y banda ancha para el móvil. Esta conducta constituye fraude, incumplimiento de contrato y violación de la ley de libre competencia que regula el estado de California.
Este caso es sólo uno más de los muchos que salpican a Qualcomm, entre ellos, la amarga disputa legal que mantiene contra Nokia.
