A district court in Indonesia Tuesday cleared PT Newmont Minahasa Raya of any wrongdoing in a lawsuit filed by an environmental group earlier this year. "The witnesses for the prosecution cannot be certain that (the alleged environmental damage) was caused by tailings from Newmont," Ketut Manika, the leading judge in the case, told the court. Manika said prosecution witnesses had cited murkiness of the water in a bay, declining numbers of fish and fewer species of marine life as evidence of environmental wrongdoing. Newmont Mining Corp., one of the world's largest gold mining companies, on Tuesday said it has agreed to buy Canadian rival Miramar Mining Corp. about $1.53 billion. The offer of 6.25 Canadian dollars ($6.36) per share represents a 24 percent premium over Miramar's closing stock price of $5.15 on Monday in New York. Newmont Mining plans to divest a further 7% stake in its 45%-owned Batu Hijau copper-gold mine located on the remote island of Sumbawa in Indonesia. The company has offered the shares to the government for about $325 million based on a value of $4.65 billion for the mine. Batu Hijau is the only productive mine in Indonesia for Newmont, producing about 215-230 million pounds of copper and 185,000-200,000 ounces of gold per annum until 2009. Under the current mine plan, the mine life is predicted to last until 2034.

Gold miner Newmont Mining Corp. might reconsider its investments in Indonesia if one of its executives is found guilty of dumping toxic waste there, the company said on Friday. "We would have to reevaluate, given the exposure and risk," spokesman Omar Jabara said. "First, we would look at future potential investments."
