Times When It's Your Broker Who Should Handle Negotiations
While much of the negotiating for purchase of a small California business is conducted at "arms length," meaning that the principal is not present when his or her offer or counteroffer is presented to the other party, there are times when buyer and seller find themselves at the same table, where they attempt to come to an agreement on a deal.

Now that MSFT has walked, what can we expect? Well, YHOO's management team look like fools, not only for misplaying their hand, but also for taking very lightly their fiduciary duty. Expect YHOO shareholders to revolt. I would not be at all surprised if YHOO is forced to do the deal, because the board really cannot say anything to shareholders that remotely convinces them that the company is worth $37 per share or more. Countrywide Gets More Lax On Short-sale Negotiations
Countrywide Mortgage, like most lenders and banks, used to require borrowers to miss at least one mortgage payment prior to trying to negotiate a short-sale. This didn't leave much time nor opportunity to negotiate a short-sale because the foreclosure process typically starts after a borrower has missed two payments. But that may be changing. According to a few people we've spoken with within Countrywide, they are starting to allow borrowers to try and negotiate a short-sale before they've missed their first payment. It seems that the cost of a foreclosure being higher than that of a negotiated short-sale has finally begun to make sense to Countrywide. Between the new bill that Congress just passed and Countrywide's new stance on short-sales, financially distressed borrowers can now look at a short-sale as a much easier and less expensive method of trying to get out of their hardship than ever before.

      Brown suit negotiations
Settlement talks are underway between FAMU and Michael Brown, the former inspector general who was canned by then-interim President Castell Bryant last year. Brown, who filed suit in Leon County last December, was shown the door after he began investigating allegations that Bryant and other top FAMU officials were distorting the true picture of university finances. Brown's removal helped fuel a backlash against Bryant, and is one of several decisions that seemed to turn the tide of public opinion against her interim presidency. Even Florida's Auditor General took issue with some of Bryant's claims in the Brown affair (see St. Petersburg Times  story here). FAMU trustees recently voted after a closed session to continue settlement talks, but it's unclear how close the parties are to a final deal. Court Attorneys: Preparation for Negotiations
Preparing for negotiation is, sadly, the most frequently overlooked aspect when a case reaches this case litigation phase. Once the parties of a case have reached this stage, ample preparation on what and how to negotiate is a profitable use of time and is very much worth doing. Here are the things that court attorneys must prioritize during preparations for negotiation:1. Having a clear identification of the things the client wants and those that he does not want - The court attorney should have a specific and focused idea of what his or her client wants to get out of a certain deal. He or she must also know the terms that the client does not want to be included in the outcome of the deal.Keeping in mind the general objectives is good enough. However, being limited on this may also produce general results that would lead to tendencies of resorting to second-guessing the specific terms and culminating with dissatisfaction on both sides. On the other hand, knowing the clear and specific d

It was only a matter of time before the smaller canvas edition of 3,750 would also be no longer available at the publisher level. Together, the two editions represent $4 million in retail sales for unframed work. (Erratum, the edition of 3,750 was identified on my previous post as being on paper. That is incorrect, it is also a giclee on canvas.) Update: Hillsborough teacher contract negotiations
There's good news and bad news coming out of the bargaining room this week for Hillsborough's teachers. Teachers are likely to see more money in their paychecks, with a salary increase that could range between six and nine percent, according to Yvonne Lyons, executive director for the Hillsborough Classroom Teachers Association, which bargains on behalf of the district's nearly 15,000 teachers. She explained how the money adds up: Most teachers are moving to an eight-hour work day in the coming school year, which means 20 minutes of additional work. They will be paid for the extra time, which amounts to a four percent salary increase. The union does not see this as a raise, but rather as pay for additional time worked. On top of this, Lyons said they have reached a tentative agreement with school officials to move teachers up a step, which means an increase of another two percent. In the last bargaining session, Lyons said the district offered an additional one percent raise. T

We’ve played 44 ballgames. In 17 of these 44, we’ve scored 6 runs or more. And in 27 of these ballgames, we’ve (averaged) less than 3 runs. There’s your answer. We’ve got to get more consistent scoring runs. It’s hard to win with 3 runs a game, any team.” The Cubs’ offense didn’t exactly crash the system, but it did scratch out 3 runs, and they were enough for 3-1 victory over th
