Like NASCAR entrants gunning their engines awaiting the green light, attorneys are gearing up for what could be one of the biggest legal paydays in history: the subprime debacle. From an L.A. Times story:First came the sub-prime mortgage boom. Next was the bust. Now, as surely as day follows night, come the lawsuits. All large-scale financial scandals spawn mountains of litigation, but the sub-prime fiasco stands out because of the complexity of the system that funneled more than $1 trillion from investors around the world through Wall Street and mortgage lenders to borrowers with dicey credit. As losses mount on those loans, the scene of the blame game is shifting to the courts.Sub-prime borrowers are suing loan brokers and lenders, accusing them of deceptive practices. Wall Street firms

Ford has recalled 10 million of the vehicles in seven recall efforts since 1999.Most recently the automaker recalled 225,000 Fords for a second time because engineers found the wiring harness used to repair the fire hazard to be inadequate. The parts needed to repair the first recall will not be available until June. When taken together, the cruise control recalls constitute the la

Q. I am considering filing a lawsuit against someone. Is there anything I can do to avoid this?
A. Yes, you can try to negotiate. Before you even think of going to court, try to talk with the other person in the dispute. Most potential suits are settled long before they go to court. The next chapter discusses steps to take in settling your case.

In the following press release Illinois Attorney General Lisa Madigan announced that she continues to lead the fight against mortgage and home repair fraud today by filing two lawsuits against mortgage brokers who sold complex mortgages to Illinois consumers. (The details of these lawsuits can be found in the two entries below this one). These suits are the first lawsuits filed by the Attorney General’s Office focusing primarily on the origination of mortgage products that have played a major role in the series of events leading to the current subprime mortgage foreclosure crisis. Today’s filings follow a number of lawsuits filed by Madigan targeting the subprime mortgage crisis, including eight suits against mortgage rescue scam artists that prey upon homeowners threatened by foreclosure. “Like many Illinoisans desperately trying to save their homes, the victims of these two companies have been left with few options,” said Attorney General Madigan

In our existence, each one of us one way or the other had a horrible involvement with a long-drawn-out, tiresome and most of all high-priced lawsuits. Thereupon, our once burgeoning bank accounts have taken its heaviest toll and at the drop of a hat it’s gone. Thus today, you need to yield to steadfast lawsuit settlement loans to have the necessary legal settlement funding for your costly court cases.
At one point, a former coworker and I spoke to an attorney about a potential class action lawsuit alleging workplace discrimination by a former employer. What we learned is that, depending on the size of the company and the number of Black employees, some attorneys are looking for anywhere from 20-25 participants in a class action lawsuit as the minimum number of complainants required to consider taking the case. And, an attorney may ultimately want a larger number of employees to join the class action lawsuit as it progresses. The issue for my coworker and I was that our job site was once an independent company that was acquired by another very large organization. Much of the work both companies did not overlap. And, for almost the first two years, there wasn’t a lot of work being done between coworkers of the two newly merged companies. The site we worked at was nearly completely disconnected from the majority of employees. Our job site employed about 8 Blacks on a full-time basis a
Factcheck.org found that, once again, Rudy Giuliani doesn’t have his facts right. From their summary:
Former Sen. Fred Thompson got the facts straight for his GOP debate debut Oct. 9. But former Mayor Rudy Giuliani added to a lengthening string of exaggerations and misstatements:
Giuliani claimed Sen. Hillary Clinton once called the free-market economy “the most destructive force in modern America.” She didn’t say that. She quoted another author who said free markets were “disruptive.” She also said free markets bring prosperity.
The mayor falsely claimed Clinton proposes to give $1,000 to “everybody.” Her proposed subsidies to workers’ retirement accounts would be for couples making up to $60,000 a year and would be $500 for those making up to $100,000.
Giuliani falsely claimed that more than 2 percent of the nation’s gross domestic product is spent on “frivolous” lawsuits. The figure is from a study about the co
Vonage’s share dipped to 93-cents, its lowest value since the company went public in May 2006. Vonage has been charged with the violations of three Verizon Communications Corp. patents in building its Internet phone system. The lawsuit awarded Verizon with $58-million (U.S.) in damages, plus 5.5-percent royalties on future Vonage revenues.
Reminder this was just two days after Vonage was ordered to pay Sprint Nextel $69.5-million in damages, after a jury found that Vonage willfully infringed on six Sprint telecommunications patents. The U.S. Court of Appeals for the Fourth Circuit directed the trial court to reconsider the verdict on one of the three patents, and it vacated the damages and royalty awards. They were vacated because the lower court did not specify which portion of the damages were corresponding to which patent. The appeals court found that the district court improperly created the third patent - wireless access to Voice over Internet Protocol (VoIP) service.

Thank you to the Boston Business Journal for breaking the news that a first lawsuit has been filed in relation to the failed Harborview at the Navy Yard condo development, the interesting part of this, is that the lawsuit is not coming from upset buyers that got their deposits back and a pat on the back, but from the construction crew that built Harborview, Turner Construction Company.
Essentially, Turner Construction is claiming that Trammel Crow, Harborview’s owner, did not have the money to pay Turner, and Trammel Crow misled Turner into finishing the job (to the tune of $10 million). Unfortunately, that which is surrounding the Harborview project continues to get worse.
The suit highlights the risks of building large-scale condominium projects in Greater Boston’s softening residential real estate market. The market’s turn has prompted some developers, particularly those with properties priced in the midrange, such as HarborView at the Navy Yard, to convert condomi
As soon as the Minnesota Interstate 35W Bridge collapsed, there was an immediate call from the public regarding who was responsible for this tragedy. While the cause and responsibility of the bridge collapse may be 6 months to 1 year away as investigators put together the pieces of what had happened, initial reports say that lawsuits are immanent.
Private contractors and insurers could face hundreds of millions of dollars in wrongful death lawsuits and to a much lesser extent, the government could face a much smaller payout as well. Minnesota state’s liability is limited to $1 million total in the incident. Besides wrongful death, other insurance claims will most likely involve auto claims, property damage, worker’s compensation and even business interruption.
In November 2006, Advanced Medical Optics, Inc., a vision products manufacturer, recalled nearly 3 million units of Complete MoisturePLUS contact lens solution because of sterility problems that could lead to eye infections.Since then, the solution was linked to a serious corneal infection known as acanthamoeba keratitis, and multiple products-liability lawsuits have been filed against the company. All of the plaintiffs claim to have contracted acanthamoeba infections while they were using Complete MoisturePLUS to disinfect their contact lenses.Acanthamoeba keratitis is serious business. The infections can be chronic and are often resistant to treatment; sometimes they require corneal transplants and can even lead to blindness.Aside from the risks of the contact lens cleansers -- you probably remember the outbreak of fungal eye infections caused by contacts solutions that spread across the country last year -- contact lenses themselves are not a natural vision tool. But if you’re think

I just read about Collier County Commissioner Jim Coletta (see picture) of Naples, FL suing a builder to get their $28k deposit on a preconstruction back. I hope the legal fees aren’t more than say…$500. On a similar note, a group has filed a class action lawsuit to stop the construction of a luxury high rise. That would be an interesting approach to get out of preconstruction. Find some environmental issue and halt the construction…I’m sure everyone would get their money back. Or just spill hot coffee on yourself.
Since the Supreme Court decision in Winkleman, many have predicted a big increase in special ed lawsuits. The holding of Winkleman was that parents may appear in federal court to represent their children and themselves without a lawyer. I'm not sure that this ruling will be a catalyst for a large upswing in new filings. Parents already had the right to bring the administrative, or "due process," hearing without a lawyer. The Supreme Court decision applies only to appeals in federal court. Also, it is difficult enough to navigate the federal court procedures for lawyers. I don't think that many unrepresented parents will be able to be successful. On the other hand, many parent advocates seem to be psyched up by a "win" in the Supreme Court. The last two decisions by the Supremes were largely seen as anti-parent by these groups.

What constitutes and adequate system of schools? This question was recently thrown out of a Kentucky circuit court (Young v. Williams) over a technical issue regarding the separation of powers. So, it's back to the drawing board for Kentucky. But many states have similar actions pending. In California "lawmakers now have more than 1,000 pages of research documenting loads of problems with the state's schools and estimating how much it would cost to successfully educate every child. The landmark package of 22 studies released last week by Stanford researchers calls for at least a 40 percent increase in education funding and an overhaul of the way the state governs its schools....Lawyers call them "adequacy" suits -- and about 30 states have been slapped with them, said Molly A. Lemon Lawsuits Squeeze State Courts Jersey judiciary steers parties into mediation to handle surging caseload Monday, July 31, 2006 BY KATE COSCARELLI Star-Ledger Staff It started with an Eagle Premiere that had a wacky cooling system that spewed gunk all over the car. Two young lawyers, just starting out, took the case, brought their client a nice resolution and claimed $30,000 in fees. That was 15 years ago. Today, Robert Silverman and Craig Thor Kimmel are at the center of a small but growing part of the legal world. They specialize in lemon lawsuits, with seven offices in six states, including one in Cherry Hill, a staff of 22 lawyers and several mechanics. "We're certainly kept plenty busy," Kimmel said. "Now there are other firms that have taken on this work. People are more concerned with making sure they get their money's worth." It has been nearly 25 years since states started adopting lemon laws to protect people who buy f

I got an e-mail from Lik-Sang today, as I’m sure many other Lik-Sang customers did, with very sad news. As of today, 10/24/06, Lik-Sang will be permantenly closing their online doors. If you missed the title of this article then you’ll be surprised to find out that its apparently due to the avalanche of lawsuits levied on them by Sony.
For the full dope, straight from the importer’s mouth, visit Lik-Sang’s official announcement.
In the past I’ve mostly bought hardware from Lik-Sang, usually items like the GP2X which aren’t available for retail in the US. Even when I could find items for sale in the US, Lik-Sang’s price was about the same but their shipping was always more affordable. It’s really a sad day for gamers who are interested in the import scene. I have little doubt that this “victory” for Sony (which is really a loss for gamers) will result in similar action against other importers on other continents.
Good-bye
Willett Elementary School in Massachusetts has banned tag, touch football and any other “unsupervised chase game” during recess due to concerns over injury and liability. Principal Gaylene Heppe approved the ban, saying that recess is a time when accidents can happen. This comes a few years after the district criticized dodgeball for being “exclusionary and dnagerous.” Willett is not the only school to have done this:
Elementary schools in Cheyenne, Wyoming, and Spokane, Washington, also recently banned tag during recess. A suburban Charleston, South Carolina, school outlawed all unsupervised contact sports.
Some parents appreciated the school’s concern for their children’s safety while others felt that the school was micromanaging the students’ lives.
