Judge Orders Production of Paralegal's Notes
MARSHALL, Texas -- U.S. District Judge Leonard Davis ordered defendant Time Warner to produce a flowchart created by its paralegals in order to identify further parties to the litigation. In an effort to identify proper parties and address liability issues, Judge Davis granted the plaintiffs' request for production of defendants' partnership agreements and a flowchart developed by Time Warner's paralegal on Nov. 20. Defendants argued the documents are irrelevant as the proper parties are named. Although granting the plaintiffs' request, the judge denied the plaintiffs' request for sanctions against the defendants. I'm not sure what this means for paralegal work product, although it seems ominous. Would the plaintiffs be granted access to an attorney's notes? Probably not.

Judge Orders Bush Administration to Issue Global Warming Report
Taken from the RINF website.By Karen GulloThe Bush administration violated U.S. law by failing to produce a study on the impact of global warming and must issue a summary by March, a federal judge ruled.District Judge Saundra Armstrong in Oakland, California, said the U.S. government “unlawfully withheld action” required under the Global Change Research Act of 1990 to update a research plan and scientific assessment of climate change. The law mandates the research plan should be revised every three years and the assessment every four years. The last research plan was in 2003 and the last assessment was published in 2000. Greenpeace International and two other environmental groups who say the U.S. government suppresses science on climate change sued in November seeking a court order to produce the reports.“As the research plan is now more than a year overdue, the court orders that a summary of the revised proposed research plan be published in the Federal Register no later than Mar

Judge Orders Rep. John Murtha to Testify in Marine Sergeant Defamation Case
Finally Murtha might get what he deserves for accusing a Marine of war atrocities. He, along with the Justive department had assumed he was immune from prosecution due to being a Congressman. US District Judge Rosemary M. Collyer feels otherwise. Collyer said she was troubled by the idea the lawmakers are immune from lawsuits regardless of what they say to advance their political careers.John Murtha is now required to give a sworn deposition as to his accusations. I can already hear the loony left squawking about what a “chilling effect” this will have on the nations lawmakers. Well, maybe that’s not such a bad idea. When you have lawmakers making unfounded accusations of this sort maybe they shouldn’t be able to hide behind the law. Here’s a startling thought…maybe they should be responsible for what they say and do the same as the rest of us? ~RJH Fox News article link Judge Orders Rep. Judge Orders Britney To Undergo Drug & Alcohol Testing!
According to IMDB.com, a Judge Scott Gordon has ordered Britney Spears to undergo random drug & alcohol testings. Apparently, Judge Gordon “is concerned about the singer's apparent "habitual, frequent, and continuous use of controlled substances and alcohol" and he wants to investigate. He has ordered Spears to "undergo testing," which will be conducted randomly twice a week”. Yet, Spear and K-Fed 50/50 custody arrangement will remain the split “until test results have been determined”. Furthermore, “Judge Gordon ruled that each party is restrained from making derogatory remarks about the other party and the other party's family or significant other. The judge has also insisted that both Federline and Spears meet with a parenting coach for a minimum of eight hours each week”. Judge Orders FBI to Release Abuse Records
A judge has ordered (pdf) the FBI to release agency records about its abuse of National Security Letters (NSLs) to collect Americans’ personal information. The ruling came just a day after the EFF urged (pdf) the judge to immediately respond in its lawsuit over agency delays. This is the same case in which an internal FBI audit found that the bureau potentially violated the law or agency rules more than 1,000 times while collecting data about domestic phone calls, e-mails and financial transactions in recent years.   EFF sued the FBI in April for failing to respond to a Freedom of Information Act (FOIA) request about the misuse of NSLs as revealed in a Justice Department report. More evidence of abuse was uncovered by the Washington Post, and EFF urged the judge Thursday to force the FBI to stop stalling the release of its records on the deeply flawed program. The Washington Post writes: An internal FBI audit has found that the bureau potentially violated the law or agency r

O.J. WON’T SEE ANY MORE BOOK MONEY: Judge orders all future profits directed to Goldman family.
A judge has prevented O.J. Simpson from pocketing any further proceeds from his cancelled book and corresponding TV special. The money, along with rights to the book “If I Did It,” will be sent directly to the family of Ron Goldman, who was killed along with Simpson’s ex-wife Nicole Brown Simpson in 1994. O.J. was acquitted of the murders, but found liable in a civil court and was ordered to pay the families a $33.5 million judgment – which has since grown closer to $38 million with interest. In an attempt to collect the money, Goldman asked the court to order that funds from the book/TV deal be applied toward the judgment. On Tuesday, Los Angeles County Superior Court Judge Gerald Rosenberg barred Simpson from receiving any further compensation, and ordered the bundled book rights to be auctioned off – with proceeds directed to the Goldman family. "This is a guarantee that if they ever publish this thing, Mr. Simpson won't see a dime from it," Go
