Is exposure to generalized offensive comments enought to create a hostile environment?
Yesterday, we examined Reeves v. C.H. Robinson Worldwide in discussing whether an employer has an obligation to ban the use of radios in the workplace to prevent harassment. Today, we'll look at the other interesting aspect of the case, whether conduct that is offensive to women, but not targeted at them, constitutes sexual harassment. Reeves alleged that the following sexually offensive language permeated the work environment each and every day for nearly 3 years. Notably, Reeves did not allege that any of the offending conduct was directed at her specifically. Instead, it appears that she was subjected to the same crude language as her male co-workers. For example, one of Reeves's co-workers frequently used sexually crude language that offended her, including: Often using the phras

Microsoft Calls Yahoo Rejection "Unfortunate," Pursues Hostile Takeover
Microsoft plans to take its bid for Yahoo directly to shareholdersIn the world of mergers, there are numerous levels of "hostility" which characterize bids. There are unilateral talks, mutually agreed upon, which are typically labeled as more germane, even if one company ends up absorbing the other. Then there are unsolicited bids, such as Microsoft's initial offer to Yahoo, which are often labeled as "partially hostile". On the far end of the spectrum are "fully hostile" bids, in which one company tries to bypass another company’s executive and board leadership by offering a buyout directly to shareholders. Among the famous examples of takeovers considered "hostile" was the HP and Compaq merger, which passed by a meager 51% margin in a shareholder vote.Having been rejected by Yahoo's

Every Hostile Work Environment is Different
We each go through our own little versions of hell, when we’re combating racism on the job. While there may be some similarities with the things we go through (e.g., being isolated from staff, being ignored, being called by racial epithets, etc.), there are so many nuances to our experiences that no two hostile work environments are really the same.Black employees need to really become familiar with the term a “hostile work environment.” Far too often, I think we brush off a lot of the offensive behavior at work because we may not have been called a ni**er or we may not have been subjected to a noose hanging from a light fixture. But, if we are dealing with behavior that is persistent and pervasive, that makes it hard for us to do our jobs, we may need to have someone look into wheth

His latest book, Hostile Takeover: How Big Money and Corruption Conquered Our Government--And How We Take It Back,is an in-depth look at how this culture of corruption has twisted the way that government works today. From his site:Do you ever wonder if there's a connection between the increasingly frequent corruption scandals in the news and the steady decline in the quality of life for millions of Americans? Do you ever wonder what corporations get for the millions of dollars they pour into the American political system? Do you ever think the government has been hijacked by forces hostile to average Americans? Do you ever want to fight back?If your answer to any of these questions is "yes," then Hostile Takeover is your guide.Millions of Americans lack health care, millions more struggle to afford it. The God Delusion, part 8 – What’s wrong with religion? Why be so hostile
I do not think that religion is the only source of evil in this world. Humans have an instinct to form groups, and to amplify the differences between the in-group and the out-group. I am myself a fan of Manchester United, and for some weird reason I can get a little bit upset when someone criticize a player in the team or something similarly harmless. Now, I would never act on such feeling, however, there are fans or hooligans who in fact get into fights for such reasons, unbelievable as that may sound… I think that mankind will probably always find something to fight about, however, I also think that religion is the worst culprit of all when it comes to creating conflicts between groups. In chapter eight of The God Delusion, Richard Dawkins addresses the very frequent question "what is wrong with religion"? The danger of Islamic fundamentalism is obvious to most people. Last weekend I watched the movie United 93. Even though I have seen those planes fly into the world trade center t

Single Incidences that Create a Hostile and Offensive Work Environment
Normally for an employee to claim they were the victim of a hostile and offensive work environment, the employee must prove that they have been the victim of repeated incidences of mistreatment and abuse in the workplace. The incidences must be severe enough to change the conditions of the employee’s status and must be pervasive and disruptive enough that it is hard or impossible for the employee to do their job. But, there are single incidences that are legally recognized as immediately being vile enough to rise to the level of creating a hostile and offensive work environment for an African American employee. Therefore, it would only take one occurrence to create a workplace situation that would require immediate action from a supervisor or other member of authority within a company. Two examples of single incidences that can immediately create a hostile and offensive work environment are:1. The use of a noose or burning cross in the workplace, which is used

Who's Really Being "Hostile" In the Workplace?
Scenario #1: A white mid-level worker approaches a Black mid-level worker and asks the Black mid-level worker to perform administrative tasks for him/her. The white mid-level worker is not the manager or supervisor of the Black mid-level worker and isn’t in any position of authority over the Black worker. The white mid-level worker hasn’t even approached the Black mid-level worker’s actual supervisor for permission to ask them to do work of any level—let alone administrative work! The Black mid-level worker informs the white mid-level worker, “I’m sorry, but I’m not an administrative assistant. I don’t perform the tasks you need assistance with. Even if I could provide you with assistance, it wouldn’t be fiscally responsible for someone making my salary to be performing that type of work. Perhaps you should speak to the boss about getting some help with that.” The White mid-level worker leaves the encounter and reports to the Black employee’s White supervisor that

      New Zealand "Hostile" Accommodation
Backpackers make up a large portion of our tourist numbers. These mainly young travellers are well catered for in the many first rate Hostels that dot the country and cities alike. However, not all hostel accommodation in NZ offer the independent traveller a safe environment. Another recent incident involving theft and attempted rape against an Asian backpacker has highlighted the not so uncommon risk associated with this form of communal accommodation. Like many western countries, New Zealand's social services are under increasing budget pressure as central Government look for new methods of cost cutting. So what does this have to do with backpackers safety in Hostels? Simply it is a three fold social problem - 1 - Rising rentals mixed with a decrease in Government and Local Council subsidised housing has led to an increase in some members of the community accommodating themselves in hostels. These people tend to be unemployed and rejects of the state housing sector. They drift from
