      Even though this blog is called the Ohio Employer's Law Blog, I often write about issues that come up outside of Ohio because I think they will be of interest to Ohio businesses. Abdullahi v. Prada, decided recently by the 7th Circuit, is one such issue. It discusses the similarities and differences between race, nationality, and ethnicity, how they are often intertwined in employment discrimination issues, and the linguistic tightrope we often walk in trying to distinguish among them.       Dedicated to all those ethnic minority doctors out there. Please complete the ethnic census data so doctors of the future can challenge the GMCEthinicity Census has been met with some skepticism from the asian population. Nevertheless, it is the only way to move forward against the GMC on discrimination law. The basics of discrimination law is enshrined in statistics and also comparators. No one of course has asked the GMC why they have not collected these statistics in the 100 or more years they have been in existence. In addition, no one asks the GMC why they have ensured that no statistics exist so no one has the evidence of the statistics for the past - basically, we have no idea how many doctors the GMC have discriminated against before 2007. It is only when this point was raised to them by Dr Sushant Varma and myself did they move to correct it. We have to say that the GMC have been extremely clever in their omission of statistics and crowing to the world that they have not been

      SUSHANT VARMA SUCCEEDS - GMC STARTS TO COLLECT ETHNICITY DATA
      Earlier this year, Sushant and I discovered that the GMC were not collecting ethnic data as stipulated by the Race Relations Act. This was reported to the CRE by Sushant Varma. The complaint was taken up and subsequently investigated by the CRE and it has achieved an agreement from the GMC that they will collect ethnicity data. Neither Sushant Varma or I will be mentioned in Hospital Doctor but both of us achieved as we were the doctor's who spotted this flaw in the GMC's system. This flaw prevents any doctor from challenging the GMC at an Employment Tribunal. Now that should be corrected. It is therefore vital for doctors to give the GMC their ethnic data for us to have some idea on whether the GMC is racially discriminatory statistically. The exchange of correspondence is within this section. On April 2007 the Commission of Racial Equality wrote to us in the following terms "Enforcement and Public Duty team has raised the matter with GMC and are currently in communication with them

      The U.S. Department of Education has pushed back implementation of controversial new requirements for classifying students by race and ethnicity, but is holding firm in the face of objections to changes requiring that institutions report some students as being members of more than one race.Under final guidance issued by Secretary of Education Margaret Spellings and published in the Federal Register Oct. 19, schools must update as needed their method of student-data reporting to the Education Department no later than the 2010-11 school year—one year later than was announced when the guidelines were proposed last year.The revised system conforms to guidelines established in 1997 by the White House Office of Management and Budget and reflected in the 2000 U.S. Census.
