But, the farmer, seeing what had happened rushed out with his shotgun and yelled, "See here! That duck belongs too me!"The city boy replies, "But I shot the duck, therfore it belongs to me!"The farmer says, "It fell on my property so it belongs to me!" They continue to argue, each claiming ownership of the duck. After awhile the farmer says, "We should settle this the old-fashioned way."The city boy asks, "What is the 'old-fashioned way'?"The farmer explains, "First, I kick you in the groin. Then, you kick me in the groin and we continue in this fashion until one of us gives up. The one who wins gets the duck."The city b

Continuing our discussion of the four dispute resolution mechanisms under IDEA, this week we will begin to examine the due process hearing and the major changes in the hearing process under the 2004 reauthorization and the new federal regulations. As many of you know, this is the method where a lot of my work is involved. I am a hearing officer for West Virginia and Utah, and a special hearing officer for Alaska. I work with and train hearing officers from many states, and I consult with states about their due process systems. Many of my comments to the feds when they were contemplating new regs involved the hearing process. Many of the changes in IDEA'04 and the new regs involve the hearing system. I think that Congress and OSEP were expressing at least some dissatisfaction with the

Continuing our discussion of the four dispute resolution mechanisms under IDEA, this week we will examine mediation and the major changes in mediation under the 2004 reauthorization and the new federal regulations. As previous posts have noted this is my favorite method. Mediation is the only option which allows repair of the relationship between parents and the school district. A good mediator will work on any relationship issues. Because the ultimate concern is the education of a child, a good on-going relationship is critical. The major change in the mediation section of the law under IDEA’04 is the new requirement that a state must make mediation available to the parties at any time. Section 615(e)(1). The statute previously had only required that mediation be available after a due pr

Some Scientists Will Not Speak Out PubliclyFor Fear Of Retribution Over 400 prominent scientists from more than two dozen countries recently voiced significant objections to major aspects of the so-called "consensus" on man-made global warming. These scientists, many of whom are current and former participants in the UN IPCC (Intergovernmental Panel on Climate Change), criticized the climate claims made by the UN IPCC and former Vice President Al Gore. The new report issued by the Senate Environment and Public Works Committee's office of the GOP Ranking Member details the views of the scientists, the overwhelming majority of whom spoke out in 2007.Many of the scientists featured in this report consistently stated that numerous colleagues shared their views, but they will not speak out publicly for fear of retribution. Joining forces in charter dispute
Twenty cases challenging the state's right to deny school districts exclusive authority over charter schools soon could become one. Lawyers for both the Department of Education and the 20 districts challenging the department's action denying their charter school powers have agreed to consolidate the several court appeals into a single case in the 1st District Court of Appeal. "It's an effort to conserve judicial time," not to mention the time and money of the several school districts that all are fighting the same fight, said Ron Meyer, the high-powered lawyer who is working the matter for the Florida School Boards Association. "The parties are agreeing that it ought to be done. The court gets to decide." Meyer expected the court to rule on the proposal in January. At issue is the constitutionality of the Florida Schools of Excellence Commission, which the Legislature created in 2006 as an alternate route for charter schools to follow instead of applying to school districts for pe

Dispute Resolution: When Parents and School District Disagree
Some of the work I do in special education law focuses on dispute resolution. Special ed law is new law. Lawyers generally consider anything that came over on the boat from England to be old law; everything else is new. Laws that came into existence in the 1970's are brand new. Lawyers are more comfortable with old law like contracts and property, where there is often a settled "hornbook" answer, and they can advise their clients with relative certainty. So many lawyers are very uncomfortable with special ed issues. To make matters worse, the procedural rules are strange to seasoned attorneys. In most areas of the law, the aggrieved party must pick a forum. In special ed, however, it is possible for an aggrieved party to pursue four different dispute resolution mechanisms- and this is before going to court. Needless to say, this is very frustrating to lawyers who dislike ambiguity. In special ed law, the party who disagrees, usually but not always the parent, has four options whi

How To Dispute Negative Items On Credit Report
STEP ONETell the consumer reporting company, in writing, what information you think is inaccurate. Include copies (NOT originals) of documents that support your position. In addition to providing your complete name and address, your letter should clearly identify each item in your report you dispute, state the facts and explain why you dispute the information, and request that it be removed or corrected. You may want to enclose a copy of your report with the items in question circled. Send your letter by certified mail, “return receipt requested,” so you can document what the consumer reporting company received. Keep copies of your dispute letter and enclosures.Consumer reporting companies must investigate the items in question — usually within 30 days — unless they consider your dispute frivolous. Oh no, not another dispute!
Well folks! We have another big dispute in the horizon today. :-(I’m referring to that article published by MalaysiaKini earlier today about Koperasi Angkatan Tentera’s reluctance in recognizing a Malaysian Indian lady as the rightful beneficiary of her deceased son who was a Muslim convert.I’m sure that this particular matter would later be manipulated by some irresponsible parties, creating more hatred and misunderstanding towards Islam. :-(First of all, I have to say that Koperasi Angkatan Tentera was not entirely wrong in their reluctance. They have some basis for standing in that position. The deceased was a Muslim, thus all of his worldly affairs that he left behind have to be scrutinized under the Islamic Law and Jurisprudence, including his inheritance.Let me quote for you folks a well known Hadith, quote:“Usamah bin Zaid, may Allah be pleased with him, reported:Allah's Messenger (may peace be upon him) said: A Muslim is not entitled to inherit from a non-Muslim, and a

Better Numbers: The evidence of a drop in violence in Iraq is becoming hard to dispute
I wonder if it is painful for the editorial staff at the major papers to acknowledge, even just occasionally, that they have been wrong on issues. I have seen them attempt to justify not reporting good numbers saying that is the ‘responsible’ way to do it. In this case it is an honest appraisal of the facts but I had to chuckle at the lead in line:“The evidence of a drop in violence in Iraq is becoming hard to dispute”. But they usually still try. Watch the video at the link above to see what I mean. But in the case of this story, kudos to this Washington Post editorial staffer. At least this one journalist gets it. ~RJH Washington Post article link Better Numbers The evidence of a drop in violence in Iraq is becoming hard to dispute.Sunday, October 14, 2007; B06NEWS COVERAGE and debate about Iraq during the past couple of weeks have centered on the alleged abuses of private security firms like Blackwater USA. How to Dispute Your Credit Report
Consumer reporting agencies, also known as credit bureaus, collect financial information from you from any lending institutions with which you have a relationship. This financial information is compiled into a credit report. If you’ve ever had a credit card, any type of loan, or a collection account, chances are you have a credit report. Whenever you apply for a credit card, a mortgage, or any other type of loan from a lending institution, the lenders and creditors will use your credit report to determine whether or not they should extend credit to you. They base this decision upon how you pay your bills. This information is found in your credit report. If the information contained in your credit report is incomplete or inaccurate, you could be turned down for credit. In the case that your credit report indeed has information that is not correct, you are permitted to dispute this information. The Fair Credit Reporting Act provides you with the advantage of having the information pro
