Fertility is a very touchy subject. Most people assume that it is easy for a couple that wants to get pregnant to get pregnant. Unless you experienced a prolonged inability to conceive, and the fertility treatments that go along with it, it's difficult to understand the stress it causes. Part of that stress is caused by the time away from work. Fertility treatments, particularly in vitro fertiliza
When the EEOC is investigating compensation discrimination, they look at a few things that you can examine yourself.1) What are similarly situated employees (same job, job classification, job level, etc.) being paid? Can you show that your White counterparts are making more money than you?2) Can your employer reasonably defend the difference in pay status for similar employees? Is there a legitima

Sen. Greg Brophy, R-Wray of Colorado, has introduced a stunt amendment arguing that gay people do not need a bill to protect against discrimination.
"The debate on the Senate floor over a bill that would expand the prohibition of sexual orientation-based discrimination became personal and emotional this morning after a senator offered a rhetorical amendment to ban discrimination against short people.
Sen. Greg Brophy, R-Wray, withdrew the stunt amendment after arguing that there is no need for the bill because he has not seen evidence that gays and lesbians are discriminated against when seeking a job or a home.

When an adverse employment decision is made by a person who lacks impermissible bias, but was influenced by another individual who was motivated by such bias, is the employer liable for this rubber-stamped decision? While courts have not conclusively answered this question, the majority answer is yes. The leading case recognizing this theory of liability is EEOC v. BCI Coca-Cola Bottling Co. It famously describes this type of discrimination as "cat's paw" liability. "Cat's paw" derives from a fable in which a monkey tricks a cat into scooping chestnuts out of a fire so that the monkey can eagerly gobble them up, leaving none left for the cat. It generally describes a situation where one is unwittingly manipulated to do another's bidding.
Last week, the EEOC reported that it settled with

"Gay rights advocates urged Collin County commissioners on Tuesday to adopt a hiring policy that prohibits discrimination based on sexual orientation.
Commissioners are considering a proposed policy that would ban discrimination based on “sex, race, creed, disability or national origin.” It does not specifically mention sexual orientation. “To exclude sexual orientation and gender identity/expression from your policy sends a clear message to the people affected by it,” said Morris Garcia, president of the Collin County Gay and Lesbian Alliance. He said the suggested policy would allow “bigoted opinions in the workplace that can only equate to a hostile environment, poor productivity, and unfair/unequal treatment.”

A new study from Yale University suggests the converse trend: rather than feeling tolerance in our society, the overweight and obese say they feel more heavily discriminated against now than they did a decade ago. Led by Tatiana Andreyeva, a postdoctoral research associate at Yale's Rudd Center for Food Policy and Obesity, a team of researchers questioned 1,100 subjects, aged 35 to 74, twice over a 10-year span . Participants answered nine additional questions about everyday experiences, such as how they were treated in restaurants, and whether they had encountered name-calling, harassment or threats. The subjects were asked to indicate the reasons they felt they had been discriminated against whether it was because of age, gender, race, height or weight, physical disability, religion

This morning's Wall Street Journal has a piece on the growth of EEOC pregnancy discrimination charges. According to the Journal:
Pregnancy-bias complaints recorded by the Equal Employment Opportunity Commission surged 14% last year to 5,587, up 40% from a decade ago and the biggest annual increase in 13 years.... The groundswell reflects both changing demographics and a new activism among mothers. It also shows that even now, 30 years after passage of the federal Pregnancy Discrimination Act, there is still confusion about what protections it provides. "I thought we were protected," said an advertising executive during a recent gathering of 100 working mothers. "Then I find out we can be fired while we're pregnant, employers can refuse to hire us -- what exactly are our rights?"

SAY NO TO RACISMThe International Day for the Elimination of Racial Discrimination is observed annually on 21 March. On that day, in 1960, police opened fire and killed 69 people at a peaceful demonstration in Sharpeville, South Africa, against the apartheid "pass laws". Proclaiming the Day in 1966, the General Assembly called on the international community to redouble its efforts to eliminate all forms of racial discrimination (resolution 2142 (XXI)).
When it comes to being targeted at work, there are many different ways to define what is happening in the office. Some people may argue that they are being subjected to a problem related to systemic discrimination on the job (e.g., Blacks have been historically denied promotions, almost without exception), some people may argue harassment (e.g., a hostile and offensive environment due to racial prejudice), and some people may argue retaliation (e.g., they made some sort of informal or formal complaint, which resulted in the complaining employee being targeted at work). Each situation is different because people and workplaces are different. One racist coworker or a company promoting racism is going to be different from the next, even though there may be some similarities in the excuses used
Senate Bill 305, introduced in the Ohio Senate yesterday, would include "sexual orientation" in the list of protected classes against which it is illegal for employers to discriminate. It defines sexual orientation as "heterosexuality, homosexuality, bisexuality, asexuality, or transgenderism, whether actual or perceived." According to today's Cleveland Plain Dealer, if S.B. 305 passes, Ohio would become the 22nd state to ban this type of discrimination. The Plain Dealer also points out that only one Republican crossed party lines to sponsor the bill, which does not bode well for its ultimate fate.

Last week I talked about avoiding common traps in the questions that are asked during job interviews. The questioning, however, is not the end of this story. John Phillips' Word on Employment Law points out that even if the right questions are asked, the notes that interviewers take during the process can prove just as damaging. Interviewers always take notes. The notes enable the interviewer to remember key points about candidates and make pertinent comparisons at the end of the process. The key word, though, is "pertinent." John's point, which is an important one, is to make sure that any notes that are taken are job related and deal with a candidate's experience and skills, and not a protected class:
So, you would never write "black," "AA" (even if your explanation is that this stands

Do women face sexism and discrimination in Qatar?I've recently been working on a new page for the website, Working Women in Qatar, and while I was doing it I decided to ask a few women if they felt they were at a disadvantage here. The first lady I asked, who was Filipinno, worked as a secretary in a workshop in the Industrial area, and didn't feel she had received any discrimination based on sex.Next I spoke to a business woman. Interestingly, she felt that while she had felt some sexism, it had all come from either Western expatriates ("who have been here too long") or from shop workers. Her feelings were echoed by a British teacher I spoke too, although she added that it was nothing she couldn't deal with.I also spoke to an American-Arab. She felt that a much bigger problem than sexism was discrimination on the basis of nationality. Hence, with her American passport she would receive a much higher wage than an Arab or Indian with the same experience and qualifications doing the s
Former Fresno State women's basketball coach Stacy Johnson-Klein was awarded $19 million last week in a sex discrimination lawsuit against the school. Johnson-Klein argued that she was fired in March 2005 because she is a woman and because she advocated for gender equality at the university. She also argued that the school investigated her when she complained of gender discrimination, sexual harassment and Title IX violations at the school, reports the Fresno Bee.The jury deliberated for less than four hours before delivering the unanimous verdict. Johnson-Klein told reports outside court that "for women in general, I think, it's a victory to see that there's a justice system in America. You can use it. It's long, it's hard, it's not for the weak of heart. But it works."This verdict marks the second sexual discrimination decision against the California school this year, reports the Associated Press. Former women's volleyball coach Lindy Vivas was awarded $5.85 million in July.
It’s okay to discriminate. So long as those you’re discriminating against are generally poor (that is, can’t afford to lose a job), native Spanish speakers, Mexican, and have the extreme gumption to speak anything but the king’s English when they are at work. This is essentially what the U.S. Congress said this past week, as it continues to hold hostage the annual appropriation for the U.S. Equal Employment Opportunity Commission (EEOC) until it capitulates on the issue of litigating cases of employment discrimination based on national origin. How is it, you might ask, that Congress can reasonably demand that the agency charged with being the legal watchdogs of workplace discrimination simply not do its job? Congress did, after all, write and pass the Civil Rights Act of 1964, Title
Reverse discrimination is a ongoing problem in the NHS. The best example on evidence is Doncaster and South Humber NHS Trust who purposely picked a black psychiatrist with only a few months post registration experience and ensured he was Section 12(2) approved. In the interim, numerous well trained and experienced white/asian british psychiatrists were not given the approval as evidenced by the various applications made. There is a national shortage of black psychiatrists who are Section 12 approved which does not match the ethnic break down of patients that are sectioned. This issue was discussed on Doctors.net.uk sometime ago. Doncaster and South Humber NHS Trust kept no statistical data on race which contrary to the Race Relations Act. The approval panel is currently being investigated by the General Medical Council as they approved a black psychiatrist with minimal experience and had failed to do a CRB check. Later the doctor was given a Warning by the GMC for his flawed CRB record

Few days back i received an email from the Arab Writers Group Syndicate calling attention to the discrimination and violation of human rights by the Egyptian officials against the native Egyptian Christian community, also known as the Copts. Its totally unacceptable and also against the ethics of Islam. It must be noted that this problem is from corrupted political system, degradation of moral ethics and human value which we find so often in our troubled time.. Egyptian Christians: Strangers in their Native Land! The Copts, Egypt’s indigenous, pre-Arab, pre-Islamic Christians, are a native ethno-religious group of Egypt. Egyptian Christians trace their ancestry to the indigenous Pharaonic-era population of Egypt, converted to Christianity by St. Mark, one of Christ’s earliest disciples. Today Copts number approximately seven to twelve million people and constitute between 10% and 15% of the Egyptian population, making them the largest indigenous Christian community in both Africa a
According to the EEOC, caregiving responsibilities disproportionately affect working women and their effects may be even more pronounced among some women of color, particularly African American women, who have a long history of working outside the home.African American mothers with young children are more likely to be employed than other women raising young children, and both African American and Hispanic women are more likely to be raising children in a single-parent household than are White or Asian American women. Women of color also may devote more time to caring for extended family members, including both grandchildren and elderly relatives, than do their White counterparts.Sure, discrimination against caregivers is a problem that can impact anyone in the workplace, male or female. But, it represents a particular issue for Black, female caregivers. In fact, caregiver discrimination against a Black worker (or Hispanic, etc.) might be compounded by other forms of discrimination such
An egomaniac German playboy, age 77, found himself shut down by a 19 year old that refused to have sex with him after a night on the town. The old guy’s response? The man, Rolf Eden, is suing her for discrimination because she refused to sleep with him. The best part is the guy’s quote when questioned by the media:
“That was shattering. No woman has ever said that to me before”
I’m calling it another publicity stunt, this time from a guy desperate to show the world what a stud he is despite his declining age. Or he could just be that delusional. The guy is well known in Germany for trying to emulate Hugh Hefner and claiming to have bedded thousands of women in his life. Here’s hoping he drags the story out in the media and makes a further fool of himself, especially since he can’t seem to figure out that most of the women are after him because of the money and not because he’s the Johnny Depp of senior citizens.

Since ancient times women have been viewed, in many cultures, as men’s inferiors physically, morally, and intellectually. Today, in western cultures, women enjoy more freedom and equality than ever before in history. Despite the gains made by women in recent years, particularly in the U.S., many women worldwide still find that their access to education, employment, healthcare and political influence are limited because of their gender. These discrepancies continue to exist because many societies still maintain centuries-old social and religious laws, customs, and traditions that have created barriers to education, jobs, and healthcare, as well as deprive women of their political and civil rights.Sexual HarassmentSexual harassment is usually defined as a form of discrimination in which sexual advances or requests for sexual favors constitute a condition of a person’s employment or advancement in the workplace. It frequently occurs between a male and a female, often instigated by a m
All of us, every one of usBy Matt Foreman, Executive DirectorNational Gay and Lesbian Task ForceAt this critical moment in our efforts to pass an Employment Non-Discrimination Act (ENDA) that includes transgender people under its protections, it is important to recall just why so many of us believe that no one can be left behind. The last five days have been a grueling and defining moment in our movement’s history. When we learned that protections for transgender people would be stripped from ENDA, an unprecedented groundswell of anger, energy and determination rose up to reverse that decision. This morning, a letter signed by more than 90 national and state advocacy organizations that work on behalf of lesbian, gay, bisexual and transgender (LGBT) people was delivered to Congress, asking for more time to garner support for ENDA as it was originally introduced. Some 2,500 congregations were asked to activate their memberships to call Congress. Students are also calling and e-mailing Co
In a small town in the US, there is a rather sizable factory that hires only married men. Concerned about this, a local woman called on the manager and asked him, "Why is it you limit your employees to married men? Is it because you think us women are weak, dumb, cantankerous. ..or what?""Not at all, Ma'am," the manager replied. "It is because our employees are used to obeying orders, are accustomed to being shoved around, know how to keep their mouths shut and don't pout when I yell at them."

In today’s age of globalization, workplace discrimination is strictly forbidden by the laws of almost every state. However, there are still several companies that discriminate their employees or usually their applicants because of their race, religion or sexual preference. Remember that it is improper and unlawful for an employer to evaluate or fire an employee based on an illegal issue. And in

A class action lawsuit was filed against Niketown (Chicago, IL) in 1999 alleging race-based discrimination. The lawsuit (filed by more than 400 African American employees) alleged that Nike discriminated against and continues to discriminate against its African-American employees and managers at Niketown Chicago by:• Subjecting African-American employees and managers to a hostile working environment created by harassing activities, including the use of racial epithets; accusations and coercive interrogations regarding alleged thefts and misuse of employee discounts; greater scrutiny and monitoring of African-American employees and managers than given to their Caucasian co-workers, including extensive “check-out” searches upon leaving the store; and greater scrutiny and monitoring of African-American customers than Caucasian customers. They also say that Nike has unlawfully discriminated against its non-managerial African-American employees at Niketown Chicago by:• Segregating
