      Maybe Not Disability Discrimination
We ran a post last week about disability discrimination involving a school inclusion choir. It is interesting how people watching the same event can see many different things. We have heard from some folks this week who don't think that there was any discrimination at this event. They tell us that there were two choirs, one for grades 6 to 9 and one for grades 10-12, and that the vest was the uni

      The Disability Insurance Trap
One out of every four Americans will miss at least 90 consecutive days of work because of an injury or sickness between the ages of 35 and 65. Disability insurance can help prevent such medical disasters from becoming financial disasters. However, disability insurance is usually obtained through deeply flawed group policies offered by employers. Employees with such group coverage often aren't adeq

      Disability Discrmination
I consider myself to be an aware person. I feel like I'm attuned to the problem of discrimination. An event this week makes me wonder how aware I really am.I was attending a special ed law conference this week. The organizers arranged entertainment for a luncheon that included an "inclusion choir" from a local school. They sang three songs. Like almost everybody in the overcrowded audience, I was feeling really good about the inclusion of kids with disabilities in the choir. I thought that this was a feel good moment. I joined in the standing ovation for the choir. After the luncheon, I had a conversation with an advocate for kids with disabilities. She asked me whether I had noticed anything unusual about the choir's performance. I said yes, the choir included children with disab

Autism As Disability and Disorder - NOT Deviance
Leave it to Estee Klar-Wolfond host of "The Joy of Autism" to get it wrong again. This self appointed expert on autism actually celebrates autism - a disorder which impairs and restricts the lives of many with Autistic Disorder. And her absurd views of autism are reflected in her response to the speech by Reverend Jeremiah Wright to the NAACP.In my son's case he can not be left unattended at any time. He can not be left to wander to the end of our neighborhood street unaccompanied without risking his life. Yet this person lectures parents like me that we should find joy in our children's disability. I can not hide my lack of respect for her point of view. I heard a piece this morning on the way into work on NPR about the Disability Savings Act that would change the way we can save money for our kids futures.  Basically, if you put away money for your kid today...it could limit their ability in the future (when they can use that cash/savings) to get federal funds to help pay their way through life.  These changes, sponsored by Christopher Dodd of CT, would help to change that 'either/or' scenario many of us fear. As soon as I can find a story or the podcast on this, I'll put it up on the blog.  Here's the actual info from his Senate Web site.

The Fight for Social Security Disability
In the state of Georgia the process of obtaining benefits can be comprised of five steps, but one hopes to avoid the last four. An initial claim must be filed with the local Social Security Office. This can be done in person, over the telephone, or online. I applied online on August 1st, and after becoming very confused and frustrated, a Social Security caseworker called my home to complete the "interview process" over the telephone. She then mailed a couple of forms to be signed and witnessed, and I returned those along with my original birth certificate as requested. Weeks later I received a larger package more to the tune of a long questionnaire. I was asked how often I bathed, whether I drove my car any substantial distance, and if I had any hobbies. I had to explain how I attained gro

Do I Qualify for Social Security Disability Benefits?
Since Social Security is a government-subsidized program, the answer to this question is never simple. Basically, Social Security disability benefits are intended for those who cannot work, or at least cannot work enough to get by each month. If left to that definition, of course, many more people would be receiving Social Security disability benefits. The part that prevents some from being approved is that Social Security has what they call “the listing,” which is simply a list on paper of the medical problems that qualify and their severity. It is the government’s way of categorizing something that is very difficult to categorize. This presents two hurdles to anyone interested in receiving Social Security benefits. First, you have to present evidence that you meet the listings; or that you cannot work, or at least enough to support yourself. This evidence is usually in the form of medical records. The problem with this is that many people cannot afford t

      Disability Versus Difference?

We are trying to get Demetrius' new meds calibrated (we don't think he's taking the right amount, so we are going to tweak it up to see what comes of that...) and we discussed a few other things. One thing she said kind of stuck with me, she really doesn't see autism for Demetrius being a 'disability' so much as something that just makes him 'different'. Though I like this, and it something that I can embrace...I really didn't have the time (nor did she) to press her on what she meant here... because the Good Lord Above Knows - with all the IEPs and therapies and constant struggles we have, it is certainly more like a disability than just a difference. When making your reservation, you may want to inform the airline staff of any disability or medical condition that you may have. Living With a Disability in America - and Trying to Earn a Living
Last month we began a series of reports on living with a disability in America. We started with education. Today, in Part Two, we look at employment. To go to work, you need a way to get there. Around the nation's capital, many people take subway trains to their jobs.Federal law says public transportation systems in the United States must be accessible. What does that mean? It means that trains, buses and planes must be designed for use by people with physical disabilities. In Washington's Metrorail system, for example, lights go on and off as a signal to those who cannot hear a train arriving. Raised bumps on the ground serve as a warning to those who cannot see they are close to the edge of the platform. And there are elevators in the station, so people in wheelchairs have a way to get from one level to another. But in transit systems, like anyplace else, life is not always easy. Things like broken elevators, or no elevator at all, only create more barriers for the disabled.Accessible

The Social Security Administration assumes that the individual receives their letter five days after the date posted on the letter, unless an individual can show them they received it later. There are generally three or four levels of appeals; the first being reconsideration, second is a hearing by and administrative law judge, third is a review by appeals council and lastly is a federal court review. This post brought back an old memory. I was staying with a family who had been friends of my parents for some years. They were intelligent, educated people. They also happened to be Christians. Which was fine by me. One day we had a conversation, where they asked why I am deaf. I explained. Their reply was …. “Oh no, the REAL reason you’re deaf is because you sinned in a past life. You did something very VERY bad. This is your punishment.” Huh? What?! Run that one past me again? I was stunned. I have NO idea where they got this strange idea from. I certainly haven’t lived a past life. I cut that conversation short and walked away. Quickly. *shudder* Be any religion you want to be. Just leave me and my disability out of it.

Professor files disability discrimination suit against USF
A former assistant pediatrics professor at USF is suing the research institution, claiming she was discriminated against because of her disability while working under Jefrrey Krischer, the professor who made headlines last year after securing a $20-million federal grant to study diabetes. Susan B. Moyers was hired in October 2004 to work under Dr. Krischer, and she says she was fired last year because of her disability and requests she had made for accommodations to deal with limitations associated with her prosthetic left arm. The prosthetic arm prevents her from many activities including frequent typing, the suit states. She also has tendonitis in the right arm and "abnormalities in the cervical spine," according to the suit. Her assignment at USF did not include teaching, as she thought, but all research. Over time, "excessive typing" led to numbness in her right hand and arm, the suit claims. Moyers maintains Krischer and others in the Department of Pediatric

      What is Disability Insurance?
Disability Insurance provides you with an income stream should you become disabled and unable to work. It has nothing to do with whether you are injured at work or not - you could be at home, slip in the tub on a Saturday night and break your leg - you would be covered so long as you met the condition of "disabled" as listed in your policy. For the average 30 year old, the often quoted statistic is that there is a 1 in 3 chance they they will have a disability lasting 3 months or longer, with the average disability lasting 32 months. I've talked about how important it is since your ability to earn an income is your most important asset - especially when you are young.Let's look at a 25 year old, fresh out of University and earning $50,000 in their first job.  If we assume a 3% increase in salary every year until age 65, then this person stands to earn $3.7 million dollars over the course of his/her career. Let's call it $2.5 million after tax. That's a lot of mone

Why Disability Insurance is the most Important Insurance to have
Probably the tell tale indicator as to why I would say that is that it is also one of the more expensive insurance products out there.  That may sound like a strange reason, but you have to understand that insurance companies price policies based on how much it is likely to cost THEM if you make a claim, the probability of you making a claim and so forth - plus a little is added to make sure they pull in a profit. So if an insurance product is expensive, it basically means that either the payout is big, the likelihood of claim is big, or both. But there is more to my statement than just cost. You have to understand that your biggest asset in life is not your house, your car or your investments (at least when you are younger).  Your biggest asset is your ability to earn an income for the rest of your life!Speaking of assets - you insure your house, you insure your car, you even buy insurance in the form of warranty extensions on electronics.  You would have NO

General Medical Council and Disability Discrimination
The GMC asked what the above meant. The British Medical Association has done a great deal of work for disability. It certainly hasn't done much for whistleblowers but disability seems to be their main concern. Medical News Today features a piece on the report by the BMA. "In a report out yesterday Tuesday, 24 July 2007 the BMA called on the General Medical Council [GMC] to lead the way in promoting disability equality in the medical profession by working with other regulatory bodies, medical schools and employers". Disability Equality in the Medical Profession is a excellent report. We should though go to the past and examine the case of Heidi Cox a brave young student who took on the GMC. The Student BMJ writes about her here. I remember this case because at the time I thought the GMC were at its height of wickedness. NFL Disability Plan Draws Congressional Attention
Today, after months of complaints from retired players, the House Judiciary Subcommittee on Commercial and Administrative Law will hold a hearing to look into the league’s pension and disability plans and the way they have been managed.  Among those testifying will be former Minnesota Vikings guard Brent Boyd, who was turned down countless times despite a head injury that has left him unable to work, and Cyril Smith, the lawyer who helped represent Hall of Fame center Mike Webster’s family in a protracted battle against the plan that they finally won in 2005, three years after Webster’s death. But perhaps more significant to the retirees will be Congress’s interest in their own union, the NFL Players Association, which - as a part manager of the plan - they believe is to blame for their ordeals.  “The way I see it, they’re all tied in together,” Hart Lee Dykes, a former New England Patriots wide receiver and client of John Hogan, a lawyer who

      Disability in Qatar
With a historical emphasis on marrying within the family in Qatar, disability was always going to be high. The people in Qatar don't help themselves by eating huge quantities of sugar and fast food. Unlike in the past, when life was hard, they don't make up for it with hard physical labour either.Servants do all the house work, and expats do all hard and unpleasant physical work. For some Qataris, the only exercise is the act of staggering between house and the waiting land cruiser. Consequently, some middle aged Qataris have difficulty walking. Diabetes is high, striking many people while they are still young. While Qatar's population does not have quite the awareness of disability that many Western countries have, the Government has made an effort. There are ramps and disabled toilets in most public places now, and disabled parking is common - and, even more surprisingly for someone used to driving on Qatar's chaotic roads, respected. If you’re like us, you’ll also have been ge

      Sex and Disability Part II
The picture shows ‘Alison Lapper Pregnant’ by Marc Quinn and the English Courtesan purloined it from Alison Lapper’s website. When the English Courtesan first wrote on the topic of sex and disability in this post here here she had yet to meet a disabled client. Well now she has, so this post is both a quiet 'thank you' to her client and a debunking of some of the myths about sex and disability and also beauty...In Autumn 2005, Marc Quinn’s statue of Alison Lapper, naked and pregnant, provoked national controversy when it was placed on Trafalgar Square’s fourth plinth. Alison is a talented photographer and writer who was born without arms and with shortened legs, as the result of a medical condition called phocomelia. As the fetal medicine website puts it, ‘in phocomelia, the extremities resemble those of a seal.’ The hands and feet are usually present (and may be normal or abnormal), but the intervening arms and legs are absent. Whilst the most widely-known cause of phoc

Drama on woman with disability, 'Herb' shines with fine acting
A drama about a woman with a mental illness, "Herb" sounds like a familiar kind of movie, but remarkable acting makes it unusual to the audience.Starring Kang Hye-jung (who played the kidnapped daughter in "Old Boy") as the heroine, the film weaves a coming-of-age story on the girl with seven-year-old intelligence who loses her single mother to an illness. Aware that the subject is not new among tear-jerking dramas, the filmmakers tried to develop a feel-good ending where she faces the world by herself."There've been many good movies that had subjects like 'Herb,' but we had a point to make," sophomore director Huh In-moo, returning after "Love, So Divine," said after a press preview of the film in Seoul on Tuesday."Mothers of those children tend to say their wish is to live one day more than their children. But in 'Herb' she wishes for her daughter to live well even after her death, and she (the daughter) lives well. We started from this hopeful message."The pretty Sang-eun (Kang

      Sex and Disability
The English Courtesan was deeply moved by a documentary which highlighted a completely different aspect to the procurement and pimping debate this week, as well as some interesting issues around sex and disability. The picture shows Nick Wallis, a 22 year old who has a degree in ecology and who was a talented artist until he lost the use of his hands due to his medical condition.Nick suffers from Duchenne Muscular Dystrophy, a progressive condition for which there is no treatment or cure. Since he was young, Nick has been a frequent visitor to Helen and Douglas House in Oxford. Helen House is a children’s hospice that provides respite care for children with life-threatening or terminal conditions and Douglas House is the young adults’ hospice for those aged from 16 to 40.The English Courtesan’s UK readers may have seen the BBC2 documentary ‘The Children of Helen House’ which follows the lives of the parents, children and staff there. The English Courtesan has a general dislik

Appeal Letter to the Short-term disability Company
I recently received notice that my claim for short term disability was denied. The following is my appeal. I will give a much detail as I possibly can about the history of my illness. I’ve had bouts of major depression since 1988 when I was nine years old. It was initially triggered when I was diagnosed with Rheumatic Heart Disease. There was months at a time when I couldn’t walk or get out of bed. I would have to crawl or use crutches. I quickly began gaining weight. I was very melancholic and irritable. I constantly thought about dying and I attempted suicide several times. Classmates and teachers alike thought I was morbid because of the poems and stories I wrote and because I always wore black. In 1993, when I was 14, my mother tried to put me in Shadow Mountain Institute (a local psychiatric facility) because she found my suicide note and caught me trying to slit my wrists. I turned it around on her and made her sound like the crazy one so they didn’t hospitalize me. Had I

      Developmental disability anyone?
My brother and I talked over the phone two nights ago. The 28th was his birthday, so I made sure to call him way too early in the morning so I could rouse him out of bed and give him an irritating start to his day. Our relationship is very passive-aggressive like that. He repaid the favor by hanging up on me in the middle of my goth version of Happy Birthday.Whatever. Killjoy. So, he returned my call later in the evening, when he was more fully awake and fresh from a day of putting his Master's Degree to work sorting big rocks from small rocks at the site of his latest archaeological survey. He had some interesting news. He has been diagnosed with Asperger's Disorder, a mild form of autism. (DDQ, PLEASE DO NOT call him about this. He is telling people as he is comfortable. Even our parents don't know.)"So, how does this change anything?" I asked him. By the way: This diagnosis? Not a surprise. My brother is an incredibly good man and a decent human being. Still, he has always been pr
