[We took a short pre-holiday hiatus this week to help out Dale Henry in his race for Texas Railroad Commissioner. We now return in full force.—VL] It should come as no surprise to Texans everywhere that House Speaker Tom Craddick’s public relations machine is in full force this week giving his version of disinformation relating to last week’s opinion by Texas Attorney General Greg Abbott on the power of the speaker’s office. On Craddick’s website, he offers a separation of “fact from fiction” concerning the opinion issued last week. We’re going to put Speaker Craddick’s “mythbusting” to the test with a little fact checking of our own. According to Craddick: Myth: The Attorney General agreed with the Speaker's detractors that the Speaker doesn't have absolute discretion as it relates to the right of recognition of privileged motions Fact: The Attorney General rejected opponents' invitation to arbitrate a House Rules d

Attorney General Hands Speaker Craddick An Early Christmas Present: Absolute Power & Emasculation Of Impeachment
Late last night, Texas Attorney General Greg Abbott issued his long-awaited opinion on questions related to the authority and removal of Texas House Speaker Tom Craddick (R-Midland). Nor surprisingly, Abbott sided with Craddick. In short, Abbott ruled that the Speaker is a statewide officer and is thus subject to impeachment under Article XV, Section 7 of the Texas Constitution. However, Abbott did rule that “impeachment is not the only way to remove a speaker,” pursuant to “expulsion” under Article III, Section 11 of the Texas Constitution or “exclusion” under Article XVI, Section 2 of the Texas Constitution, as well as other remedies availiable under Section 665.007 of the Texas Government Code. Of course, Abbott doesn’t say what those other remedies are, but does include this incredible misinterpretation of the state constitution: If the Speaker were impeached, the Texas Constitution allows the impeachment judgment to extend to, but need

Bush Picks Mukasey As Attorney General
In a rather surprising move, President Bush is going to nominate New York Judge Michael Mukasey as a replacement for the embattled Alberto Gonzales to head the Department of Justice. I say it is a surprising move because Mukasey has received high marks from Democrats as well as Republicans. The far right wing of the Republican party has been rumored to be talking of ways to block the nomination of Mukasey saying he is not conservative enough to suit them. I am pleasantly surprised as I was really expecting Bush to nominate another of his long time political hack friends to the post. Perhaps Bush is afraid of another drawn out and painful confirmation process. Mukasey was the judge to sentence the blind Sheik Omar Abdel-Rahman to life for attempting to bomb buildings in New York. The Solicitor General Ted Olson was floated initially as a possible nominee but is seen as too highly partisan to survive the confirmation process. ~RJH MyWay News article link Bush Picks Mukasey As Attorney Ge

Today Alberto Gonzales announced his Resignation from his position as Attorney General of the United States. While many on the Right will move to defend Gonzales, I am certainly not one of those people. Alberto Gonzales was an abject failure, who demonstrated utter incompetence. Had Alberto Gonzales not held the position, virtually none of the fake scandals would have arisen. There are some major benefits to Gonzales’ resignation, however, other than a competent person taking his place. The first benefit is that the Democrats are not going to be able to deflect attention from their own shortfalls. With Karl Rove and Alberto Gonzales gone, this may require the Democrat Party, led by Nancy Pelosi and Harry Reid, to actually accomplish something. Since Nancy Pelosi and Harry Reid took office, not only has this Congress become one of the most corrupt in history, but neither The Speaker or the Majority Leader can get their Party in order. Now the American people can tell Reid and Pelo

White House: President Bush Pleased with Attorney General's Testimony
This is from the White House website and ostensibly the opinion of President Bush. We shall see. ~RJH White House website press releasePresident Bush Pleased with Attorney General's Testimony President Bush was pleased with the Attorney General's testimony today. After hours of testimony in which he answered all of the Senators' questions and provided thousands of pages of documents, he again showed that nothing improper occurred. He admitted the matter could have been handled much better, and he apologized for the disruption to the lives of the U.S. Attorneys involved, as well as for the lack of clarity in his initial responses. The Attorney General has the full confidence of the President, and he appreciates the work he is doing at the Department of Justice to help keep our citizens safe from terrorists, our children safe from predators, our government safe from corruption, and our streets free from gang violence.

Gonzales at the Senate Judicary Oversight Hearing, April 19, 2007, WASHINGTON, D.C.Good morning Chairman Leahy, Ranking Member Specter, and Members of the Committee.www.flickr.comI want to begin by recognizing those who died and were injured Monday. The tragic events in Blacksburg have shocked and saddened Americans, who have come together this week to grieve, to remember, and to try to make sense out of this senseless act of violence. I offer my prayers and condolences to the victims, their families, and friends.I also want to recognize the law enforcement personnel who bravely responded to the scene. As I watched Monday’s events unfold, I was filled with pride watching men and women risk their lives and care for victims in the line of duty. Moments like these underscore my commitment to the mission of law enforcement -- and the honor that

An Open Letter to Attorney General Alberto Gonzales From Gary Busey
Alberto,Can I call you Alberto? Al? Senor lawyer-guy? Or how about the-dude-who-is-totally-up-shit's-creek? Cuz that's what you are. You know that, right? Yeah, all that "nothing to hide" shit is cute and all, but you are deader than my career. In fact, you're deader than my son's career. You know what? That's dead. Dead, I say.You want some advice? Just fess up and tell them that you snorted the drugs. Wait, that's not why you're in trouble. Oh yeah, the lawyer firing stuff. You know, I'm not really a politics guy, but it seems to me that everything you've ever done in the history of your life, including this firing stuff, was wrong. Therefore, you should resign your office and pay off my extensive credit card debt. Yup, resigning office is not going to be good enough. You also need to pay MY bills, because that's what the American public would want. How do I know that? I'm an American, gosh darnit, and I know what my people want. Sure, you're an American

U.S. Attorney General Alberto Gonzales responds:
I must say, this is a gross oversimplification of an immigration policy that, I believe, is well-attuned to the political and practical exigencies of today's socio-market economy. I have outline the prosecutable parameters for multiple illegal entry into the United States. They are:1st offense: Individual will be afforded: 1) return bus ticket to country of origin; and 2) 8 x 10" photograph of George W. Bush signed, "Come again ya'll! George 'That's El Presidente To You' Bush."2nd offense: Individual can expect: 1) courtesy escort to country of origin; 2) complimentary "Hungry Hombre" plate at Nogales Denny's (gratuity not included); and 3) 5 x 7" photograph of George W. Bush signed, "I appreciate your initiative! George 'I'm Practically A Mexican Myself' Bush."3rd offense: Individual may receive: 1) verbal warning; 2) AAA map showing shortest route between Disney's California Adventure and Tijuana; 3) 3 x 5" photograph of George W. Bush signed, "I hear Canada's lovely this

      Attorney General "Honesty' Claim
The Attorney General, Lord Goldsmith, has sought to reassure MPs that any dealings he has with the Crown Prosecution Service over the cash for honours police investigation will be fair and square and made public. He will, in short, be open and honest. This is from politics.co.uk:- Lord Goldsmith has been criticised for refusing to stand back from the Scotland Yard probe, amid concerns that his close relationship with the prime minister - who has been questioned twice by police - represents a conflict of interest. … “My duty is to the law and not to party politics and party loyalties,” he told MPs. He confirmed that if asked for his advice on the cash-for-honours probe - the attorney general is generally consulted in corruption probes - he would ask for independent advice. “In the event that there was no prosecution I would make public that advice. It would be transparent. People would know what the reasons were and why,” he said, adding it would be

Eliot Spitzer's Ranking as Attorney General
The nation’s State Attorney Generals have been ranked using specific criteria.  I have maintained, since way before Day 1, that Eliot Spitzer abused the power of his office to extort settlements out of private enterprises.  Those actions were done for the intent of enhancing his political stock and to aid his ambition for more power and a higher elective office.  Spitzer easily made the list of the Top Ten Worst Attorney Generals. Although these abuses are widespread, some attorneys general are worse than others. Based on a set of explicit criteria—such as encroachment on the powers of other branches of government, meddling in the affairs of other states or federal agencies, encouragement of judicial activism and frivolous lawsuits, favoritism towards campaign contributors, ethical breaches, and failure to provide representation to state agencies or to provide legal advice—the following state attorneys general have earned the dishonor of being the nation's To
