Although anything to bring some brand of “integrity” to death penalty cases in Texas is a good thing, you have to wonder about the timing of the Texas Court of Criminal Appeals’ decision to create a new “integrity unit” to examine and problems in the criminal justice system:

Microsoft asked Europe’s second-highest court to overturn or reduce a record fine of 899 million euros ($1.4 billion) from the European Union. The appeal was filed at the European Court of First Instance in Luxembourg, a Microsoft spokesman, Jesse Verstraete, said in an e-mailed statement. The European Commission, the E.U.’s antitrust authority, fined the company on Feb. 27 for failing to comply with a 2004 antitrust order. Under that decision, in which Microsoft was fined 497 million euros, the E.U. ordered the software maker to provide data to rivals to allow servers to connect to the Windows platform.

A Court of Criminal Appeals ruling on fetal murder last week garnered the obligatory media attention, but few seemed to pay serious attention in part, I suspect, because the AP story and every other coverage included an interesting tidbit in the lead graf or somewhere pretty close to the top:
Texas laws allow the killing of a fetus to be prosecuted as murder, regardless of the fetus’ stage of development, but they do not apply to abortions, the state’s highest criminal court has ruled. [Emphasis mine.]
Is this, however, disinformation?
The folks at Dungeon Diary seem to think so:
Though this was about a criminal case, abortion foes will seize this as legal precedent to begin pressing for criminal prosecutions of doctors offering abortions. Just wait for the dust to settle. I doubt that these same folks who have decried “Activist Judges” will have little but praise for this decision.
I’ll admit, I had similar thoughts. I felt that this decision would be
The chessboard killer got life in jail, for 48 killings, meaning he didn't achieve his goal of becoming Russia's most prolific serial killer of all time. So what's his next step? He filed an appeal with Russia's Supreme Court, because he feels his punishment is "too harsh":
"At Pichushkin's request I filed an appeal expressing disagreement with the punishment, which he finds too harsh," lawyer Alexander Karyagin told Interfax.
What, I only killed 48 people, and you're going to send me to jail for life? That's not fair! He picked the wrong country to be a serial killer in, though. In some western countries, he'd probably have been released by now. He's just a misunderstood victim of society, after all. Or he should have hired some of O.J.'s lawyers.

According to this article a Kansas court has ruled that just being in the United States ILLEGALLY is not a crime. If you are in the country illegally, how can it not be a crime? Maybe I am a retard as quantumd suggests in his comments on a couple of my previous posts, maybe I have low reading comprehension skills as he also suggests, but I thought illegal meant illegal, and if you did something illegal it was a crime. What am I missing here? Quantumd, please enlighten me, I would send you a trackback, but you leave me no link. Okay, to hell with quantumd, now on to an important subject.
If you can get past the border guards and into the United States, you’re no longer violating the law, according to a Kansas Court of Appeals decision.
While it is illegal to enter the country without the proper documents and permissions, it is not necessarily illegal to be in the country.

Twenty-seven Florida schools got some good news today, when the state Department of Education announced it had approved their appeals on either their state grade or adequate yearly progress rating for the 2006-07 school year.
Locally, Dover Elementary in Hillsborough got boosted from a C to a B. Sheehy, Alexander and Egypt Lake elementary schools in Hillsborough, and Dunedin, Mount Vernon and Pinellas Central elementary schools in Pinellas were judged to have made adequate gains in all subgroups of students.
On the downside, Cox Elementary in Pasco kept its D grade and Foster Elementary in Hillsborough remained an F school. Also, Lealman Avenue and Sandy Lane elementary schools in Pinellas did not see changes to their AYP status.
The state did not act on 38 AYP-only appeals related to the USDOE's decision to exclude students with disabilities who took an alternative test to the FCAT. The state is working with the feds to gain waivers for those schools.

AT&T has asked the U.S. 11th Circuit Court of Appeals to clarify its ruling from last week in overturning an injunction that had allowed the AT&T logos on the No. 31 Richard Childress Racing car. Part of the Aug. 13 ruling indicates that the entire case should be dismissed, and AT&T is asking for clarification on whether the entire case should be dismissed or whether only the portion of the case that deals with breach of contract be dismissed. NASCAR and Sprint, which has joined the suit, believe the entire case should be dismissed, and U.S. District Court Judge Marvin Shoob indicated to both parties that if there was no clarification from the appeals court, he would be compelled to dismiss all of the claims, according to court documents filed by AT&T. "Although the context and posture of this appeal indicate that the Court [of Appeals] could not have intended to require dismissal of the entire case, the Court should grant rehearing on this poin

The U.S. Appeals Court on Friday reversed a lower court decision to allow going ahead with the class action suit. The lawsuit was initially filed by Kennith Shroyer, complaining that Cingular dealt poorly with customers after it bought AT&T Wireless in 2004. Cingular told AT&T customers that they would not be able to keep the same rates if they didn't comply. After Kennith Shroyer's complaint, Judge Manuel Real ruled at the U.S. District Court for the Central District of California in favor of Cingular's argument that the case was outside that court's jurisdiction and should instead go to arbitration, due to a clause in

Have you ever seen an advertisement for a hamburger or similar food product and thought to yourself "That looks good, I think I'll get that"? Have you gone and bought the hamburger after looking at the advertisement? Have you then realized that, despite what you originally believed, the actual hamburger looks nothing like the hamburger being advertised? Hamburger advertisements are a major reason why the internet appeals to you and me.Let me explain.Advertisers know that, in order to sell their product, they have to make their product appeal to the masses. For the example of a hamburger: advertisers hire professional photographers, who use professional lighting to take shots from special angles. The advertisers spend hours putting together a simple hamburger - though, in the real world, it would take 35 seconds to slop together. They create the perfect product to be advertised. It's not cheating, but it's not quite the truth. The surprising thing is that you and I don't care. We see

Ascension Alverez-Tejeda and his girlfriend drove up to a traffic light. As the light turned green, the car in front of them lurched forward, then stalled. Alverez-Tejeda managed to stop in time, but the truck behind him tapped his bumper. As Alverez-Tejeda got out to inspect the damage, two officers pulled up in a police cruiser and arrested the truck driver for drunk driving. The officers got Alverez-Tejeda and his girlfriend to drive to a nearby parking lot, leave the keys in the car and get into the cruiser for processing. Just then, out of nowhere, someone snuck into their car and drove off with it. As the couple stood by in shock, the police jumped into their cruiser and chased after the car thief with sirens blaring. The police then returned to the parking lot, told the couple that the thief had gotten away and dropped them off at a local hotel.

The International Trade Commission has ruled that Toyota did not pilfer key technology from Solomon Technologies to create the Synergy Drive system used in ToMoCo's hybrids. Solomon CEO Gary G. Brandt is undaunted. "We believe the ITC made serious errors in interpreting the pertinent patent law and precedents in this case and as we have reviewed the case transcripts more fully we are even more convinced that we will eventually prevail." Speaking to TTAC [below] Brandt says his company had "numerous documented meetings" with Toyota prior to the release of the Japanese automaker's hybrid system. What's more, since the Prius was released, Toyota has licensed [what Brandt claims to be] Solomon technology to Ford. The legal action continues. Meanwhile, Solomon has posted an animation on their website highlighting the similarities between the two systems.
